costs incurred including applicable overhead, in addition to collecting the liquidated <br />damages. For the purposes of this section, "substantial completion" means the <br />ability to safely utilize the facility for its intended purpose, without interference or <br />additional risk to persons or property due to any work remaining to be completed, <br />related equipment, tools and the like. <br />DELAYS AND EXTENSIONS OF TIME; DELETE Paragraph 8.3.1 and replace with the <br />following paragraph: <br />8.3.1 lf the Contractor is delayed at any time in the commencement or progress of <br />the Work by an act or neglect of the Owner or Architect, or of an employee of <br />either, or of a separate contractor employed by the Owner, or by changes ordered <br />in the Work, or by labor disputes, fire, unavoidable casualties or other causes <br />beyond the contractor's control, or by delay authorized by the Owner pending <br />mediation, or by other causes which may justify delay as determined both by the <br />Architect and Owner, then the Contract Time shall be extended by Change Order <br />for such reasonable time. <br />Delete the words "and arbitration" from Subparagraph 8.3.1. <br />ADD new Paragraph 8.3.4 <br />8.3.4 The Contract time shall be adjusted only for changes in the work pursuant to <br />Article 7, and excusable delay pursuant to this Paragraph 8.3 as determined by the <br />Architect. ln the event the Contractor requests an extension of the Contract time, <br />he shall furnish such justification and supporting evidence as the Architect may <br />deem necessary for a determination as to whether the Contractor is entitled to an <br />extension of time under this Contract. After receipt of such documentation, the <br />Architect shall make his findings of fact and so advise the Contractor in writing. The <br />determination shall be based upon the approved Contractor's schedule current at <br />the time of the delay. <br />ARTICLE 9 . PAYMENTS AND COMPLETION <br />CONTRACT SUM: ADD the following to Paragraph 9.1: <br />CHANGE Subparagraph 9.1.1 to include the requirement that the Contract Sum and <br />adjustment thereof shall include all taxes imposed by law except the Washington <br />State Sales Tax, which will be paid by the Owner to Contractor, who shall pay tax to <br />the State of Washington in accordance with the law' <br />9.2 SCHEDULE OF VALUES <br />Add the following to Subparagraph 9.2.t: <br />This schedule shall allocate at least I% of the Contract Sum, (in addition to the <br />statutory retainage described in Subparagraph 9.3.4) to that portion of the Work <br />between Substantial Completion and Final Completion, to be entitled "Final <br />Documentation and Project Closeout", which will be paid as part of the final <br />payment.
