lowest total cost. The rate for equipment necessarily standing by for future use on <br />the Work shall be 5O% of the rate established above. <br />d. Prime Subcontractor's Proposals <br />These are payments the Contractor makes directly to Subcontractors for changes <br />work performed by the Subcontractor of any tier. Subcontractor's cost of Work is to <br />be determined as in a, b, and c above. <br />e. Fees <br />This is the allowance for all combined overhead, profit, and other costs, including <br />all office, home office, and site overhead (including project manager, project <br />engineer, and <br />superintendent's time), and includes delay, acceleration, and impact costs of any <br />kind, added to the total cost to the Owner of any Change Order, Construction <br />Change Directive, Claim or any claim for additional work or extra payment of any <br />kind on this Project. lt shall be strictly limited in all cases to the following schedule: <br />(1) Fee by the Contractor When actually Performing the Work <br />A total amount, not to exceed 15% of items a, b, and c above will be allowed. <br />This is to compensate such contractor for all personnel not defined in a (L) <br />above; temporary construction facilities; home office costs; office engineering <br />and estimating costs; and profit plus any other cost incidental to the <br />performance of the change in work. <br />(2) Fee by the Contractor or Subcontractors When not Actually Performing the Work <br />Contractor <br />(a) A total amount not to exceed 6% of the total amount of Subcontractor's <br />proposal as defined in item 'd' above will be allowed for the Fee marking up the <br />Work of the Subcontractor's actually performing the change in the Work. <br />(b) No direct labor by the Contractor will be allowed added to a Subcontractor's proposal, <br />Contractor's direct labor, if required, must be submitted as outlined in Direct Labor Costs. <br />(3) Subcontractor Administering but not Performing the Work <br />ln the case of a Subcontractor of any tier providing pass-through administration of <br />a change, i.e., a change in which Work is performed by a lower tier Subcontractor to <br />a Subcontractor, the administering Subcontract will be limited to a maximum of 6% <br />Fee on the amount of the changed Work performed by its sub-subcontractor. A <br />maximum total of 15% Fee will be allowed for administration by the administering <br />Subcontractors and Contractor combined on Work performed by lower tier <br />Subcontractors. ln no case shall the total amount of Fee computed on a change, <br />including that for Contractor, Subcontractor, or lower tier Sub- Subcontractor, <br />exceed a total of 3O%. <br />f.
