31. PrevalinglWage: <br />The Contractor shatt pay the prevaiting rate of wages to a[[ workers, [aborers, or mechanics <br />emptoyed in the performance of any part of the Work in accordance with RCW 39.1 2 and <br />the rutes and regutations of the Department of Labor and lndustries. The schedu[e of <br />prevaiting wages rates for the tocal.ity or locatities of the Work is determined by the <br />lndustriat Statistician of the Department of Labor and lndustries. lt is the Contractor's <br />responsibitity to verify the appticabte prevaiting wage rate. lt is understood that the <br />Contractor is responsibte for obtaining and compteting att required government forms and <br />submitting same to the proper authorities. <br />Disputes regarding prevail,ing wage rates shat[ be referred for arbitration to the Director of <br />the Department of Labor and lndustries. The arbitration decision shatl be final and <br />conclusive and binding on att parties invotved in the dispute as provided for by RCW <br />39.12.060. <br />32. Debarment Certification : <br />The Contractor certifies that it: <br />32.1 ls not presentty debarred, suspended, proposed for debarment, declared <br />inetigibte or votuntarity exctuded from covered transactions by any Federat <br />department or agencY. <br />32.2 Has not within a three-year period preceding the execution of this contract <br />with Kittitas County, been convicted of or had a civil. judgment rendered <br />against them for commission of fraud or a criminaI offense in connection <br />with obtaining, attempting to obtain, or performing a pubtic or private <br />agreement or transaction, viotation of FederaI or State antitrust statutes or <br />commission of embezztement, theft, forgery, bribery, fatsification or <br />destruction of records, making fatse statements, tax evasion, receiving <br />stolen property, making fal,se claims, or obstruction of justice. <br />32.3 ls not presentty indicted for or otherwise criminatty or civitty charged by a <br />governmental, entity (Federat, State, or locat) with commission of any of the <br />offenses enumerated in paragraph 32.2 of this section' <br />32.4 Has not within a three-year period preceding the preceding the execution of <br />this contract with Kittitas County had one or more pubtic transactions <br />(Federat, State, or loca[) terminated for cause of defaul't. <br />Kittitas Cou nty Prof essiona I Services Agreement <br />Page13of18
