Waiver of any breach or condition of this Agreement shatt not be deemed a waiver of any prior
<br />or subsequent breach. No terms or conditions of this Agreement shatL be hetd to be waived,
<br />modif ied or deteted except by an instrument, in writing, signed by the parties hereto.
<br />29. Survivat:
<br />Theprovisionsof paragraphs7,9,11,13,14,15,16, 17,'18,19,20,21,22,23,24,28,30,and
<br />31 ,32 shatt survive, notwithstanding the termination or invatidity of this Agreement for any
<br />reason.
<br />30. Nondiscrimination:

<br />30.2 Nondiscrimination in Emptoyment
<br />ln the performance of this Agreement, the Contractorwittnot discriminate
<br />against any empl.oyee or appticant for emptoyment on the grounds of race,
<br />creed, color, nationaI origin, sex, sexuaI orientation, maritaI status, age or
<br />the presence of any Sensory, mental or physicat handicap; provided that
<br />the prohibition against discrimination in emptoyment because of
<br />handicap shalt not appty if the particutar disabitity prevents the proper
<br />performance of the particul,ar worker invotved. The Contractor shatl ensure
<br />that appticants are emptoyed, and that emptoyees are treated during
<br />employmentwithout discrimination because of their race, creed, color,
<br />nationaI origin, sex, sexuaI orientation, marital status, age or the presence of
<br />any sensory, mental or physicat handicap. Such action sha[[ include, but
<br />not be timited to: emptoyment, upgrading, demotion ortransfers,
<br />recruitment or recruitment advertising, tayoff or termination, rates of pay
<br />or other forms of compensation, and programs fortraining inctuding
<br />apprenticeships. The Contractor shatl take such action with respect to
<br />this Agreement as may be required to ensure fut[ comptiance with locat,
<br />state and federat Laws prohibiting discrimination in emptoyment.

<br />The Contractor witl, not discriminate against any recipient of any services or
<br />benefits provided for in this Agreement on the grounds of race, creed,

<br />presence of any sensory, mentaI or physicat handicap.
<br />30.4 lf any assignment andlor subcontracting has been authorized by the County,
<br />said assignment or subcontract shatL inctude appropriate safeguards against
<br />discrimination. The Contractor shatt take such action as may be required to
<br />ensure futt compl,iance with the provisions in the immediatety preceding
<br />paragraphs herein.
