BOARD OF COUNTY COMMISSIONERS KITTITAS COUNTY, WASHINGTON RESOLUTION NO. Development Agreement by and between Kittitas County- and Ranch on Swank Creek THIS DEVELOPMENT AGREEMENT ("Development Agreement") is entered into and effective this day of 2024, by and between Kittitas County, a political subdivision of the State of Washington ("County") and Ranch on Swauk Creek LLC, a corporation organized under the laws of the State of Washington ("Developer"). This Agreement is made pursuant to Revised Code of Washington ("RCW") 36.70B.170 and Kittitas County Code ("KCC") Chapter 15A.11. RECITALS 1. KCC 15A.11 authorizes the execution of a development agreement between the County and a person having ownership or control of real property within its jurisdiction. 2. This Development Agreement by and between Kittitas County and the Developer relates to the development to be known as "Ranch on Swauk Creek" (or simply, the "Project'). 3. The Developer owns certain real property (the "Property") consisting of 487.43 acres, is located in an unincorporated area of Kittitas County and is accessed off of Highway 97 The subject property is approximately a total of 487.43 acres and is located west of US HWY 97, and south of Ranch and Burke Roads of sections 27, 28, 33, 34 all within T 20N., R 17E., W.M. in Kittitas County. Parcel numbers 20-17-28000-0007, -0006, - 0001, -0004, -0003, -0002, -0005, 20-17-33000-0001, -0008, -0023, -0025, -0019, - 0024, -0026, 20-17-28030-0010, -0011, 20-17-27030-0005, -0007, -0002, -0009, - 0006, -0003, and 20-17-34000-0002, -0006. 4. On December 5, 2006, the Board of County Commissioners approved Ordinance 2006- 006, granting the Ranch on Swauk Creek Planned Unit Development (RZ-06-00027), and Plat (LP-06-00027) for the Developer to pursue the Project at the site above. 5. KCC 15A.11.020(2) requires a development agreement to set forth the standards and other provisions that shall apply to, govern and vest the development, use and mitigation of the development of real property for the duration specified in the agreement. 6. For the purposes of this Development Agreement, "development standards" includes, but is not limited to all of the standards listed in KCC 15A.11.020(5) and/or as Development Agreement - Page 1 of 12
