Staff Findings of Fact <br />A Development Agreement application was submitted to Kittitas County Community Development <br />Services department on January 25, 2024. After additional information was provided, this application <br />was deemed complete on June 23, 2024. <br />2. The Notice of Application for the Development Agreement was issued on June 24, 2024. This notice was <br />published in the official county paper of record and was mailed to jurisdictional government agencies, <br />adjacent property owners and other interested parties. The last day to submit written comments was on <br />July 26, 2024. Multiple agency and public comments were received. <br />3. The draft Development Agreement includes provisions for a thirty year timeline to complete the PUD <br />from the date of DA approval. <br />4. The preliminarily approved Ranch on Swauk Creek project is located in an unincorporated area of Kittitas <br />County and is accessed off of Hwy 97 to Burke Road and Ranch Road in portions of Sections of sections <br />27, 28, 33, 34 all within T 20N., R 17E., W.M. in Kittitas County. Parcel numbers 20-17-28000-0007, - <br />0006, -0001, -0004, -0003, -0002, -0005, 20-17-33000-0001, -0008, -0023, -0025, -0019, -0024, -0026, <br />20-17-28030-0010, -0011, 20-17-27030-0005, -0007, -0002, -0009, -0006, -0003, and 20-17-34000-0002, <br />-0006. <br />5. The subject property is zoned "Rural 5," with a PUD overlay until such time that a final development plan <br />is approved pursuant to KCC 17.36. <br />6. Correspondence following the Notice of Application was received during the 30-day comment period for <br />the development agreement application. 9 comments were received, six agency comments and three <br />public comments. <br />7. Pursuant to WAC 197-11-600(4)(a) the County has adopted the SEPA MDNS issued on September 25, <br />2006 as part of the original Ranch on Swauk Creek Planned Unit Development. <br />Staff Conclusions: <br />1.
