KITTITAS COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />PUBLIC WORKS — BOARD OF COUNTY COMMISSIONERS <br />STUDY SESSION STAFF REPORT <br />STUDY SESSION DATE: July 8, 2024 <br />TOPIC: Winch Road Right of Way Proposed Vacation <br />ACTION REQUESTED: Direct Staff <br />LEAD STAFF: <br />Cameron Curtis <br />RECOMMENDATION: <br />Schedule a public hearing receiving testimony regarding the proposed vacation of Winch <br />Road Right of Way. <br />BRIEFING SUMMARY: <br />• In 2021, the Board of County Commissioners adopted the roads within Lanigan <br />Springs Plat <br />• An Active Code Enforcement Case against parcels no. 585035 and 475035 <br />prompted Public Works to locate the Right of Way associated with Winch Road. <br />• The road will require substantial capital improvements to meet county standards. <br />• Road vacation may be considered, allowing adjacent properties to construct the <br />access <br />Winch Road provides access to parcel no. 575035. <br />BACKGROUND: <br />In the mid- 1970s, a record of survey was used to create the "unplatted" subdivision of <br />Lanigan Springs. Easements were created supporting the internal road network. The <br />individual tracts of land eventually came to the County via tax title foreclosure. The <br />record of survey does not convey nor dedicate the land supporting the roadway network <br />to the County or to anyone else. Increasingly, lending institutions are becoming aware of <br />similar access issues throughout Kittitas County. Individuals have attempted to buy these <br />lands as tax title properties through the Treasurer's Office. <br />DISCUSSION: <br />In 2021, the Board of County Commissioners adopted the roads within Lanigan Springs <br />Plat, as shown in Exhibit 1, onto the County Road network. Through this previous <br />action, the Board of County Commissioners protected County residents by ensuring <br />private individuals were not able to purchase the road right-of-way as tax title for <br />investment purposes. <br />An active Code Enforcement Case against Nicholas Coby on parcels no. 585035 and <br />475035 prompted Public Works to locate the Right of Way associated with Winch Road. <br />Page 1 of 4 <br />Public Works "Work Session Staff Report", 2024 <br />
