See also Exhibit. <br />4.2 MLE: The federally funded Marine Law Enforcement Program adminlstered by Washington State <br />Park and Recreation Commission (STATE PARKSI. For purposes of this agreement MLE <br />represents the State of Washington. lf MLE ceases to exist or is no longer the state program <br />designated to administer this federal program, then references to MLE will be understood to be <br />the State of Washington. <br />4,3 Equipment. Equipment means tangible personal property having a useful life of more than one <br />year and a per-unit acquisition cost which equals or exceeds the lesser of the capitalization level <br />established bythe non-Federal entityfor financial statement purposes, or 55,000. <br />4.4 Exhibit A document provided by the MLE Program that is also a part of this agreement and <br />incorporated by reference. See also Attachment. <br />4,5 RBS Offtcer: Recreational Boating Safety Officer is a fully commissioned law enforcement officer <br />in Washington State and has the authorityto enforce the laws of the state of Washington and <br />local ordinances. The RBS Officer must have attended the Washington state Basic Marine Law <br />Enforcement Academy or an equivalent recognized by MLE. <br />4.6 Eoating Safety lnspection: A full inspection for all safety equipmenf vessel registration when <br />required and mandatory boater education compliance when required. The results of the <br />inspection shall be documented through Washington states Statewide Electronic Collision and <br />Ticket Online Records (SEC[OR). This may be done at the time of the inspection or when SECIOR <br />is available to the RBS Officer. <br />4.7 law Enforcement Vessel: A vessel used by a law enforcement agency and shall be equipped with <br />proper markings showing it to be an official law enforcement vessel. <br />4.8 RecreationalVessel: Defined in federal regulation 50 CFR 85.11as a vesselowned and operated <br />primarily for pleasure; or a vessel leased, rented, or chartered to another for recreational use. <br />4,9 Subrecipienfi A Non-Federal entity that receives a subaward from a pass-through entity to carry <br />out part of a federal program; but does not include an individual that is a beneficiary of such <br />program. ln this agreement, the subrecipient is the successful applicant with whom Washington <br />MLE awards a Federal FinancialAssistance Grant (See 2 CFR 200.931. <br />4.10 Subrecipient Grant Agreement: Also known as a subaward. Defined in federal regulation as "an <br />award provided by a pass-through entity to a subrecipient for the subrecipient to carry out part of <br />a federal award received by the pass-through entity. lt does not include payments to a contractor <br />or payments to an individual that is a beneficiary of a federal program.
