FIRST AMENDMENT TO MEMORANDUM OF AGREEMENT BETWEEN MID-COLUMBIA FISHERIES ENHANCEMENT GROUP AND KITTITAS COUNTY PUBLIC WORKS DEPARTMENT SUPPORTING LAND USE RESTORATION ACTIVITIES THIS FIRST AMENDMENT TO MEMORANDUM OF AGREEMENT is made and entered into as of the 6' day of February, 2024, by and between Mid -Columbia Regional Fisheries Enhancement Group, hereinafter referred to as "MID-COLUMBIA FISHERIES" or "MCF," and Kittitas County, collectively referred to as the "PARTIES." WHEREAS, Kittitas County and Mid -Columbia Fisheries entered into a Memorandum of Agreement (MOA), effective April 1, 2023 and authorized by Kittitas County Resolution No. 2023-056 to define MCF's and the County's respective roles, project contributions, and specifying funding for cooperative implementation actions for the Yakima River Corridor Plan for habitat enhancement and flood risk management of the Yakima River, from the Jeffries Levee to the Yakima River Canyon; and WHEREAS, Mid -Columbia Fisheries and Kittitas County have secured additional grant funds to implement the Scope of Work described in the MOA; and WHEREAS, the Parties desire to amend the agreement to include these secured grant funds in the financial plan; and WHEREAS, all other elements of the MOA effective April 1, 2023 remain unchanged; NOW, THEREFORE, in consideration of the mutual covenants, promises, and agreements set forth herein, it is agreed by and between Mid -Columbia Fisheries and Kittitas County to replace Appendix B in the MOA with Amendment No. 1 to Appendix B Financial Plan, attached as Exhibit 1.
