BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION <br />NO. 2023 - P- Z :�) <br />DECLARATION OF EMERGENCY — Ryegrass Septage Lagoon <br />WHEREAS: Kittitas County Solid Waste, during the weekly inspection of the Ryegrass Septage <br />lagoons has found liquid in the lysmeter; and <br />WHEREAS: The Kittitas County Solid Waste Department notified our consultant to have the liquid <br />tested; and <br />WHEREAS: The liquid was test for EColi and salmonella and came back positive but very low so <br />additional testing was done to find where the effluent was coming from; <br />WHEREAS: On December 8, 2023, the county was notified that the effluent was from a human source <br />but still at a very low level; <br />WHEREAS: The Department of Ecology was notified on December 8, 2023 of the positive test; and <br />WHEREAS: The period of time during which weather conditions are likely to be favorable for the <br />repair process is limited and time is thus of the essence; and <br />WHEREAS: The time urgency renders the bidding process unusable; and <br />WHEREAS: declaring a State of Emergency, by which the Solid Waste Department is able to both <br />directly contract the original design engineer for review and approval of the plans, and <br />then contract directly with that company capable of making the repairs as quickly as <br />possible, is necessary for the preservation of public health in a manner consistent with the <br />time urgency of this repair project. Justification falls under RCW 36.40.180 — Immediate <br />preservation of public health and RCW 36.32.270 and RCW 39.04.280 which allow for <br />competitive bids to be waived in the event of the emergency. <br />RESOLVED: That it is hereby declared that there is an emergency due to the urgent <br />need to make these repairs, and that the Solid Waste Department and Commissioners are <br />authorized to enter into contracts and incur obligations necessary to combat such <br />emergency to protect the health and safety of the community and property. <br />
