2023 Docket Enabling Ordinance December 19, 2023 <br />Page 175 <br /> <br /> <br />assistance benefits. <br />12.12.03.110 Owner not to be left with uneconomic remnant that acquiring agency did not <br />offer to acquire. <br />12.12.03.120 Owner to be given written statement of amount established as just <br />compensation, summary of basis for amount of just compensation and, where appropriate, just <br />compensation for real property acquired, and damages to be separately stated in written <br />statement. <br />12.12.03.130 No owner shall be required to surrender possession before agreed purchase <br />price has been paid or approved amount of compensation has been paid into court. <br />12.12.03.140 All displaced persons must be given ninety-day notice in advance of date <br />required to move. <br />12.48.03.150 Rental amount charged to owners and/or tenants permitted to occupy property <br />subsequent to acquisition must not exceed fair market rental value to short-term occupant. <br />12.12.03.160 No action must be taken to advance condemnation, defer negotiations or <br />condemnation or take any other action coercive in nature in order to compel agreement on <br />price to be paid for property. <br />12.12.03.170 Acquiring county must acquire equal interest in all buildings, etc., located upon <br />real property acquired. <br />12.12.03.180 Acquiring county must pay recording fees, transfer taxes, etc., penalty costs for <br />prepayment of a preexisting mortgage and pro rata share of real property taxes paid subsequent <br />to vesting title in acquiring county. <br />12.12.03.190 No property owner can voluntarily donate property prior to being informed of <br />right to receive just compensation. <br />12.12.03.200 Provisions made for rodent control. <br />12.12.03.210 No owner intentionally required to institute legal proceedings to prove fact of <br />taking real property. <br />12.12.03.220 Use of federal aid project number. <br /> <br /> <br />12.12.01.010 Policy statement. <br />1. The county of Kittitas, hereinafter referred to as the county, desiring to acquire real <br />property in accordance with the state Uniform Relocation Assistance and Real Property <br />Acquisition Act (RCW 8.26) and state regulations (WAC 365-24) for projects involving <br />federal funds, adopts the following procedures to implement the above statute and <br />Washington Administration Code. <br />2. The department of public works of the county is responsible for the real property <br />acquisition and relocation activities on projects administered by the county.
