2023 Docket Enabling Ordinance December 19, 2023 <br />Page 164 <br /> <br /> <br />7. Haul Route Agreement: <br />When identified as a need by the SEPA review process or by the County Engineer, <br />a haul route agreement shall be obtained by the franchised utility, developer or <br />property owner establishing restoration procedures to be performed upon <br />completion of the haul operation. <br />8. The applicant or their contractor shall provide and maintain all Washington State <br />certified flaggers, flagger protective apparel, barricades, lights, standard signs, <br />cones and other devices, equipment and personnel required to meet Washington <br />Department of Labor and Industries requirements and as necessary for the <br />protection of the public and maintenance of traffic through the limits of the <br />project at the applicant’s expense. If the county determines that traffic control is <br />in an unsafe condition, the applicant, contractor, and applicant’s engineer, if <br />warranted, shall be notified and shall be required to correct the situation <br />immediately. In circumstances involving an immediate hazard to public safety, the <br />county may make the appropriate corrections at the discretion of the County <br />Engineer or designee. The applicant shall be responsible for all costs incurred by <br />the county. <br />12.06 Land Use Developments Requiring Engineering Review in the Urban Growth Area of <br />City of Ellensburg Not Utilizing City Utilities. <br /> <br />A. Rural Road Standards <br />1. Land use developments requiring engineering review in the Urban Growth <br />Area of the city of Ellensburg not utilizing City utilities shall meet Kittitas <br />County rural road standards providing the following: <br />1. The owner/developer dedicates sufficient right-of-way pursuant to the <br />City’s road and street plan <br />2. The owner developer signs a waiver of protest for the County and City <br />to the formulation of a future Local Improvement District (LID) for the <br />development. <br /> <br />12.07 Land Use Developments Requiring Engineering Review in the Urban Growth Area of <br />City of Ellensburg Utilizing City Utilities. <br /> <br /> A. Developer reimbursement agreements
