Any appeals of a denied access permit shall be resolved through the Administrative <br />Decisions Appeals process according to KCC 15A.07. <br /> <br /> <br />12.04.07.080 Permit Conditions and Requirements. <br />A. The specific requirements for construction of the driveway approach and driveway will <br />be issued to the permittee along with the driveway approach permit. <br />B. The permittee will have 12 months from the date of issuance, as shown on the permit, to <br />complete construction of the driveway and request inspection by the Department, <br />unless a building permit is open, then expiration will run concurrent with building <br />permit expiration date. <br />C. An extension to the access permit will only be considered if construction of the <br />approach and driveway has been substantially completed and the extension request is <br />made prior to the permit expiration date. The permittee can request an extension to <br />the Department in writing. The Department will determine if the approach has been <br />substantially completed and determine the length of the extension, if granted. <br />D. The expected dates of construction and expected use of the driveway access shall be <br />included on driveway access permit application. The permittee shall notify the <br />Department at least 48 hours prior to any construction in County right-of-way. <br />E. The Department shall inspect the driveway access and the driveway upon completion of <br />construction to ensure that all terms and conditions of the permit are met. The <br />Department may request to inspect the driveway access during construction. <br />F. The construction of the driveway access and its appurtenances as required by the terms <br />and conditions of the permit shall be completed at the expense of the permittee. <br />G. It is the responsibility of the permittee to complete the construction of the driveway <br />access and the driveway according to the terms and conditions of the permit. The <br />Department may order a halt to any unauthorized construction or use. <br />H. Adequate construction signing, in conformance with MUTCD, most recent edition, is <br />required at all times during driveway access construction. This may include, but is not <br />limited to, the use of signs, flashers, barricades and flaggers.
