KITTCOM's GOVERNING AGREEMENT <br />AMENDMENT #3 <br />This Third Amendment to KITTCOM's Governing Agreement (hereinafter this "Third Amendment"), is <br />made and entered into this-7th_day of —November_, 2023 by and between KITTCOM (Kittitas County <br />9-1-1), hereby referred to as KITTCOM and Kittitas County, the participating incorporated municipalities <br />of Kittitas County, the participating Kittitas County Fire Protection Districts, and the Kittitas County <br />Hospital District Number 2, hereby referred to collectively as AGENCIES and each individually as an <br />AGENCY, who are signatories to this Agreement. <br />WHEREAS, on January 1, 2004, the parties entered into an Interlocal Agreement titled "Kittcom's <br />Governing Agreement" establishing KITTCOM, a separate public agency and consolidated public safety <br />communications center created for the purpose of providing communication and dispatch services for <br />public safety and emergencies in the participating incorporated and unincorporated areas of Kittitas <br />County; and <br />WHEREAS, pursuant to the Interlocal Agreement, as further provided in Section 17 of the Agreement, <br />the Agreement may be amended at any time by the majority action of the Administrative Board and <br />ratified by a majority of the legislative bodies of all parties to the agreement; and <br />WHEREAS, the parties desire to amend section 4 (a,b,c) by removing the requirement to hold technical <br />advisory committee meetings separate of already existing Police, Fire and EMS committee meetings. <br />NOW, THEREFORE, in mutual consideration of the terms and conditions hereinafter set forth and those <br />contained in the Agreement, it is hereby agreed as follows: <br />1. Section 4 (a), (b) and (c) of the Interlocal Agreement is hereby amended as follows: <br />a. Pre-existing standing committees (Chief/CEO, Fire Chiefs Association and EMS Trauma <br />Council) meet on a regular basis of which KITTCOM is a participant. The Director or their <br />designee shall attend these meetings to discuss KITTCOM operational matters and <br />report back to the KITTCOM Administrative Board when necessary. When matters <br />cannot be addressed in these settings, the Director or their designee will request <br />separate meetings as necessary to address operational issues with law enforcement or <br />the Fire/EMS service. <br />2. Section 11(b), (c) and (f) of the Interlocal Agreement is hereby amended as follows: <br />a. (b) Reserve and Replacement Fund -- KITTCOM's budget will include an account entitled <br />"Reserve and Replacement Fund". Each year the Administrative Board will insure said <br />fund has adequate monies for six (6) months of reserve funding or that can be used to <br />replace equipment which has failed or become unreliable. <br />b. (c) Remove section c. <br />c. (f) Shall read as follows — KITTCOM may accept gifts, grants, loans of money, tax dollars <br />as approved by RCW, equipment, or services from a lawful source. KITTCOM shall also <br />cooperate in all ways with local, state and federal government agencies and any private <br />funding sources to maximize the use of grants or gifts for equipment and operations. <br />
