Provided Karpel Solutions does not violate the provisions ofthis section regarding confidentiality, the Agreement shall not preclude Karpel Solutions from <br />developing for itself, or for others, programs or materials which are similar to those produced as a <br />result of services provided to Client. <br />INJUNcTIVE RELIEF. Any breach of the confidentiality provisions of this Section will cause irreparable <br />harm to the other party. The parties agree that the non-breaching party may enforce the provisions <br />of this Section by seeking an injunction, specific performance, criminal prosecution or other equitable <br />relief without prejudice to any other rights and remedies the non-breaching party may have. <br />MARKETING <br />Client agrees that Karpel Solutions may identify Client as a customer of Karpel Solutions in Karpel <br />Solutions'written promotionaland marketing materials, as well as in any oral orvisual presentations <br />regarding the business of Karpel Solutions. <br />Provided Karpel Solutions does not violate the provisions of the foregoing section regarding <br />confidentiality, Karpel Solutions shall have the right to demonstrate for other prospective clients any <br />application developed by Karpel Solutions under this Agreement and shall have the right to include <br />information about any such application in marketing materials and presentations. <br />MISCETLANEOUS <br />ELEcTRoNIC DocuMENTS. To the extent possible, and under the terms required by Client, Client and <br />Karpel Solutions may communicate by electronic means, including but not limited to facsimile <br />documents. Both parties agree that: a signature or an identification code ("USERlD") contained in an <br />electronic document is legally sufficient to verify the sender's identity and the document's <br />authenticity; an electronic document that contains a signature or USERID is a signed writing; and that <br />an electronic document, or any computer printout of it, is an original when maintained in the normal <br />course of business. <br />SEVERABILITY' lf any portion of this Agreement is held to be void, invalid or otherwise unenforceable, <br />in whole or in part, then the remaining portions of the Agreement shall remain in effect.
