Emergency lssues and Church Response <br />Ferioclicaily, Eilensburg United Methodist Ohurch will roquiro aeecss to thc rcntod Epac€ <br />to conduct routine maintenance. We will work to notify and deconflict this maintenance <br />witlt tlie rentet. Should the maintenance be urgent, we will work to notify the rontor but <br />will enter the space as needed to conduct the maintenance. <br />ln the event that a nonomergency maintenance issue is identified by the renter please e- <br />mail secretary@ellensburgumc.org and provide a detailed description of the issue. lf <br />emergency mainlenance is required please call Andrew Van Den Hoek at the following <br />numbers immediately, cell- (520) 508-5223, office - (509) 963-3520. lf he cannot be <br />reached please callJeff Wallace at (253) 208-2211, or Rev. Mark Wagner (865) 806-2461 in <br />that order. <br />14. Breach of Agreement: <br />ln case of breach of agreernents, the other parly shallgive notice to the party in breach, <br />stating the nature of the violation. The breaching party shall have fourteen (14) days from <br />dale of receipt of the notice to remedy the breach, lf the condition is not corrected within <br />that period, the other party may terminate this agreement immediately, provided that <br />notice of termination shall be sent to the parly in violation. <br />1 5. Mandatory Mediation: <br />a. lf a dispute arising between the two parties ol this contra-et oeeurs, both parties agree <br />that before entering into litigation, they willfirst submit such dispute for resolution to the <br />Dispute Resoluti'cn Cenier (509-925-5123) or its successor organization, and will make <br />a good faith effort to reach agreement through that process. Either party may initiate <br />the mediation process upon written notice to the other party. Each party shall bear its <br />own costs for the service. ln the event that the DRC no longer exists and has no suc- <br />cessor organization, the initiating party shall submit a list of three mediation seruices/ <br />individuals to the other party. The second party shall have ten working days to select <br />one provider from the list. lf the responding party tails to select one of the three within <br />that time, the initiating parly shallselect from the three. <br />b, This agreement {or mandatory mediation does nol apply to claims for personal injury <br />or claims that arise out of lhe commission of a crime; nor shall it atfect the amount ot <br />coutl-ordered restitution to be paid by one party to the other in a criminal case. <br />16.
