Dept. of Public Works <br />Page 2 <br />Requirements of RCW 36.87.040 Director/Engineer Report: <br />1. Whether County Road right of way should be vacated or abandoned. <br />2. Whether road is in use or has been in use. <br />3. The condition of the road. <br />4. Whether it will be advisable to preserve it for the county road system in the future. <br />5. Whether the public will benefit by the vacation. <br />6. A determination by appraisal of the fair market value of the area sought to be vacated. <br />7. The classification of the road area according to the type of expenditures made. <br />8. Whether the proposed area to be vacated contains utilities. <br />9. All other matters which will be of interest to the Board including an itemized list of costs <br />and expenses incurred in the examination, report, appraisal, and all proceedings <br />pertaining to such petition to vacate and abandon. <br />Required Report Elements Pursuant to KCC 12.22.040 (Mirror RCW 36.87.040): <br />1. Plat of South Easton found in Book 2 of Plats page 24 is dated 1902 (Exhibit 3). The 50- <br />ft. right-of-way is dedicated to the County for public use. The portion of right-of-way <br />being requested for vacation divides the applicant's parcels and terminates at the southern <br />parcel line at lots 7 and 12, adjacent to previously vacated right-of-way. <br />2. The portion of I" Street right-of-way being sought for vacation has not been in use (road <br />never built). The right-of-way crosses with an alley way which would provide an access <br />route to the property to the east. <br />3. There is no road condition to report on. <br />4. As there has been no road constructed, there appears to be no need to preserve the right- <br />of-way for public use. Surrounding parcels have either an existing access constructed, or <br />an easement to their property which does not require the use of right-of-way being <br />proposed for vacation. The alley way is proposed to remain on the plat to present <br />available ingress and egress route to a parcel to the east. <br />5. The proposed vacation allows for full use of the property by the requestor and will add to <br />the tax parcel calculation providing additional property tax value for the County. <br />6. There is no fair market valuation associated with this request as there is no adverse <br />financial impact to the County (no historic or current expense to the County for the right- <br />of-way). <br />7. There is no historic or current expense to the County for the rights -of -way. <br />8. There are no utilities of record contained in the requested vacation of rights -of -way. <br />9. The requestor has paid the Public Works "Road Vacation Application Fee" of $3,888.00. <br />The amount is expected to cover all costs associated with processing of the application. <br />The Department of Public Works recommends the Board approve the proposed vacation of <br />portions of Pt Street (EXHIBIT 2) as requested. <br />411 N.
