Provide a copy of recorded Notice to Title — For maintaining private stormwater <br />drainage system prior to final project approval. The Notice to Title is available at the <br />Public Works Department. <br />(Ord. 2015-010, 2015) <br />12.06.070 Review and Approval of Plan. <br />The stormwater plan and supporting calculations will be reviewed by the Department of Public <br />Works using the Department's construction plan review procedures in coordination with all other <br />County development and/or permit review procedures. The County's review and approval of the <br />stormwater plan shall not relieve the developer, owner and/or designer of liability for errors or <br />omissions in the design of storm drainage facilities. <br />12.06.080 Variances. <br />Variances from these Stormwater standards and guidelines may be requested by the developer in <br />accordance with Section 12.01,130. Variances shall be issued only when the following criteria exist: <br />A. There are special physical circumstances or conditions affecting the property such that <br />would prohibit the strict application of these provisions; and <br />B. Every effort has been made to find alternative ways to meet the objectives of the Core <br />Elements; and <br />C. The granting of the exception or variance will not be detrimental to the public health <br />and welfare, nor injurious to other properties in the vicinity and/or downstream, and to <br />the quality of waters of the state; and <br />D. The exception is the least possible exception that could be granted to comply with the <br />intent of the Core Elements. <br />12.06.090 Stormwater System Maintenance. <br />All newly constructed stormwater systems will be maintained at the expense of the property owner, <br />developer or other legal entity. The County will not maintain systems constructed for the purpose of <br />storage, conveyance, collection or treatment of stormwater generated on privately owned properties. <br />This responsibility and the provision for maintenance shall be clearly stated on subdivision and short <br />plat plans, property conveyance documents, and/or drainage improvement plans. <br />In the event the owner(s) does not provide property maintenance and the County Engineer <br />determines the stormwater facility represents a public safety threat, the Director will give 30-day <br />notice to the owner(s) to correct the deficiencies.
