ii. For the purpose of public safety, security of government facilities, physical security <br />surveillance of oitical infrastructure, and other national security purposes, video <br />surveillance and telecommunications equipment produced by Hytera Communications <br />Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology <br />Company (or any subsidiary or affitiate of such entities); <br />iii. Telecommunications or video surveillance services provided by such entities or using such <br />equipment;or <br />iv. Telecommunications or video surveillance equipment or seMces produced or provided by <br />an entity that the Secretary of Defense, in consultation with the Director of National <br />lntelligence or the Director of the Federal Bureau of lnvestigation, reasonably believes to be <br />an entity owned or controlled by, or otherwise connected to, lhe government of a covered <br />foreign country. <br />g. For OPSG Subrecipients, items budgeted as equipment in an approved Operations Order should <br />be marked prominenlly with 'Purchased with DHS funds for Operation Stonegarden Use" when <br />praclicable. <br />h. The Subrecipient must pass through equipment and supply management requirements that meet <br />or exceed the requirements outlined above to any non-federal entig to which the Subrecipient <br />makes a subaward of federal award funds under this Agreement. <br />5. ENVIRONMENTAL AND HISTORICAL PRESERVATIONa. The Subrecipient shall ensure full compliance with the DHS/FEMA Environmental Planning and <br />Historic Preservation (EHP) Program. EHP prpgram information can be founO at <br />httos://www.fema.gov/orants/quidance.toolslenvironmental-historic all of which are incorporated <br />in and made a part of this Agreement. <br />b. Projects that have historical impacts or the potential to impact the environment, including, but <br />not limited to, conslruction of communication towers; modificalion or renovation of existing <br />buildings, structures, and facilities; or new construction, including replacement of facilities, must <br />participate in the DHS/FEMA EHP review proc€ss prior to projec{ initiation. Modification of existing <br />buildings, including minimally invasive improvements such as atlaching monitors to interior walls-, <br />and training or exercises occurring outside in areas not considered previously disturbed also <br />require a DHS/FEMA EHP review before project initiation. <br />c. The EHP review process involves the submission of a detailed project description that includes <br />the entire scope of work, including any altematives that may be under consideration, along with <br />supporting documentation so FEMA may determine whether the proposed projecl has the <br />potential to impact environmental resources and/or historic properties. <br />d. The Subrecipient agrees that, to receive any federal preparedness funding, all EHP compliance <br />requirements outlined in applicable guidance musl be met. The EHP review process must be <br />completed and FEMA approval must b€ received by the Subrecipient before any work is <br />started for which reimbursement will be later requested. Expenditures for projects started before <br />completion of the EHP review process and receipt of approval by the Subrecipient may not be <br />reimbursed. <br />5. PROCUREMENT <br />a. Jf9 Sqbrecipient shall comply with all procurement requirements of 2 CFR 200.317 through <br />200.327 and as specified in the General Terms and Conditions (Attachment B, A.10). <br />b. For all sole source contracts expected to exceed $250,000, the Subrecipient must submit to the <br />Department for pre.procurement review and approval the procurement documents, such as <br />requests for proposals, invitations for bids and independent cost estimates. This requirement must <br />be passed on to any non-federal entity to which the Subrecipient makes a subaward, at which <br />point the Subrecipient will be responsible for reviewing and approving sole source justifications of <br />any non-federal entity to which the Subrecipient makes a subaward. <br />DHS.FEMA-HSGP.SHSP-FY22 Page 7 of 44 Kitiitas County, 823-'1 16
