WSPContractNo.CRDOO160UnderWashington'srecentlypassedKeepWashingtonWorking(KWW)law,theWSPisgenerallyprohibitedfromenforcingfederalimmigrationlaw.SeeRCW10.93.160.Thisprohibitionisinrecognitionofthefactthat,standingalone,anindividual'sunauthorizedpresenceintheUnitedStatesisnotaviolationofstateorlocallaw.Thus,neitherWSPnoranyofitsmembersmaycontractinanywaytoprovidecivilornon-criminalimmigrationenforcementassistance,includingthroughagreementsfortaskforceparticipation,mutualaid,datasharing,communicationsdispatch,oranyotheragreementthatsharesresourcesand/orprovidesdataasdescribedherein.Therefore,tocomplywithKWW,theKittitasCountySheriffsOfficeshallnotuseorshareWSPresourcesand/ordata,includinganyindividuals'personalinformationascertainedbytheWSPoritspersonnel,withanythirdpartiesortosupportorengageincivilornon-criminalimmigrationenforcementactivities.Theprohibitiononinformationsharingincludesplaceofbirth,presentlocation,releasedatefromdetention,ifapplicable,andfamilymembers'names,absentacourtorder,judicialwarrant,orasmayberequiredbythePublicRecordsAct(PRA),chapter42.56RCW.IncidentsofdisclosureofsuchpersonalinformationshallbeconsideredabreachofthisagreementandshallbereportedtoadesignatedWSPofficial.VII.COMPLIANCEa.TheUserwilloperateLivescanequipmentandmaintainstrictcompliancewithapplicablepoliciesandproceduresasidentifiedinthisAgreement.b.Fingerprintidentificationand/orcriminalhistoryrecordinformationwillnotbefurtherdisseminatedbytheUsertoanyotherperson(privateorpublic)orentity,exceptasrequiredincriminalproceedingspursuanttostateand/orfederallaws.c.UserssubmittingLivescandataandrelateddemographicinformationviaLivescantotheWSParesubjecttoauditperFBICJISSecurityPolicystandards.VIII.SUSPENSIONANDTERMINATIONa.TheWSPmaysuspendserviceshereunderwhen,initsreasonableestimation,theUserhasbreachedanymaterialtermoftheAgreement.ForthepurposesofthisAgreement,theviolationofanyspecifictermofthisAgreementorofanysubstantiverequirementorlimitationimposedbythefederalorstatestatutes,regulations,orrulesincorporatedintothisAgreementwillbedeemedabreachofmaterialtermoftheAgreement.b.TheWSPmayterminatethisAgreementiftheUsercommitsanymaterialbreachofanytermofthisAgreement,whichbreachisnotcorrectedwithinthirty(30)businessdaysafterreceiptofnoticefromWSP.Bothpartiesmay,bymutualagreement,terminatethisAgreementontermsacceptabletothem.c.NeithertheWSPnortheUserwillbeliableforanyindirect,incidental,consequentialorspecialdamageunderthisagreementarisingsolelyfromtheterminationofthisAgreementinaccordanœwithitsterms.IX.HOLDHARMLESSTotheextendallowedbylaw,theUseragreestoholdharmlesstheWINanditsemployeesandtheStateofWashington,theWSPanditsemployeesfromandagainstanyandallclaims,demands,actions,suits,includingbutnotlimitedto,anyliabilityfordamagesbyreasonoforarisingoutofanymisuseoftheABIS,WASISandWlNABISdatabases,erroneousidentifications,oranycauseofactionwhatsoever,againstanyloss,cost,expense,anddamageresultingtherefrom,includingattorneyfees.ApprovedastoFormbytheWashingtonAttorneyGeneral2018LivescantoWINABISUserAgreement05/08/2018Page4of7
