determinationofconformedclassification,wagerate,and/orfringebenefitswhichshallbepaidtoallemployeesperformingintheclassificationfromthefirstdayofworkonwhichcontractworkisperformedbythemintheclassification.Failuretopaysuchunlistedemployeesthecompensationagreeduponbytheinterestedpartiesand/orfullydeterminedbytheWageandHourDivisionretroactivetothedatesuchclassofemployeescommencedcontractworkshallbeaviolationoftheActandthiscontract.(See29CFR4.6(b)(2)(v)).Whenmultiplewagedeterminationsareincludedinacontract,aseparateSF-1444shouldbepreparedforeachwagedeterminationtowhïchaclassDes)istobeconformed.Theprocessforpreparingaconformancerequestisasfollows:1)Whenpreparingthebid,thecontractoridentifiestheneedforaconformedoccupation(s)andcomputesaproposedrate(s).2)Aftercontractaward,thecontractorpreparesawrittenreportlistinginordertheproposedclassificationtitle(s),aFederalgradeequivalency(FGE)foreachproposedclassification(s),jobdescription(s),andrationaleforproposedwagerate(s),includinginformationregardingtheagreementordisagreementoftheauthorizedrepresentativeoftheemployeesinvolved,orwherethereisnoauthorizedrepresentative,theemployeesthemselves.Thisreportshouldbesubmittedtothecontractingofficernolaterthan30daysaftersuchunlistedclass(es)ofemployeesperformsanycontractwork.3)Thecontractingofficerreviewstheproposedactionandpromptlysubmitsareportoftheaction,togetherwiththeagency'srecommendationsandpertinentinformationincludingthepositionofthecontractorandtheemployees,totheU.S.DepartmentofLabor,WageandHourDivision,forreview(See29CFR4.6(b)(2)(ii)).4)Within30daysofreceipt,theWageandHourDivisionapproves,modifies,ordisapprovestheactionviatransmittaltotheagencycontractingofficer,ornotifiesthecontractingofficerthatadditionaltimewillberequiredtoprocesstherequest.5)ThecontractingofficertransmitstheWageandHourDivision'sdecisiontothecontractor.6)Eachaffectedemployeeshallbefurnishedbythecontractorwithawrittencopyofsuchdeterminationoritshallbepostedasapartofthewagedetermination(See29CFR4.6(b)(2)(iii)).InformationrequiredbytheRegulationsmustbesubmittedonSF-1444orbondpaper.Whenpreparingaconformancerequest,the""ServiceContractActDirectoryofOccupations""shouldbeusedtocomparejobdefinitionstoensurethatdutiesrequestedarenotperformedbyaclassificationalreadylistedinthewagedetermination.Remember,itisnotthejobtitle,buttherequiredtasksthatdeterminewhetheraclassisincludedinanestablishedwagedetermination.Conformancesmaynotbeusedtoartificiallysplit,combine,orsubdivideclassificationslistedinthewagedetermination(See29CFR4.152(c)(1))."
