*ThisrateistobeusedonlywhencompensatingemployeesforperformanceonanSCA-coveredcontractalsocoveredbyEO13706,EstablishingPaidSickLeaveforFederalContractors.AcontractormaynotreceivecredittowarditsSCAobligationsforanypaidsickleaveprovidedpursuanttoEO13706.VACATION:2weekspaidvacationafter1yearofservicewithacontractororsuccessor,3weeksafter5years,and4weeksafter15years.Lengthofserviceincludesthewholespanofcontinuousservicewiththepresentcontractororsuccessor,whereveremployed,andwiththepredecessorcontractorsintheperformanceofsimilarworkatthesameFederalfacility.(Reg.29CFR4.173)HOLIDAYS:Aminimumofelevenpaidholidaysperyear:NewYear'sDay,MartinLutherKingJr.'sBirthday,Washington'sBirthday,MemorialDay,JuneteenthNationalIndependenceDay,IndependenceDay,LaborDay,ColumbusDay,Veterans'Day,ThanksgivingDay,andChristmasDay.(Acontractormaysubstituteforanyofthenamedholidaysanotherdayoffwithpayinaccordancewithaplancommunicatedtotheemployeesinvolved.)(See29CFR4.174)THEOCCUPATIONSWHICHHAVENUMBEREDFOOTNOTESINPARENTHESESRECEIVETHEFOLLOWING:1)COMPUTEREMPLOYEES:Thiswagedeterminationdoesnotapplytoanyindividualemployedinabonafideexecutive,administrative,orprofessionalcapacity,asdefinedin29C.F.R.Part541.(See41C.F.R.6701(3)).BecausemostComputerSystemsAnalystsandComputerProgrammerswhoarepaidatleast$27.63perhour(oratleast$684perweekifpaidonasalaryorfeebasis)likelyqualifyasexemptcomputerprofessionalsunder29U.S.C.213(a)(l)and29U.S.C.213(a)(17),thiswagedeterminationmaynotincludewageratesforalloccupationswithinthosejobfamilies.Insuchinstances,aconformancewillbenecessaryiftherearenonexemptemployeesinthesejobfamiliesworkingonthecontract.Jobtitlesvarywidelyandchangequicklyinthecomputerindustry,andarenotdeterminativeofwhetheranemployeeisanexemptcomputerprofessional.Tobeexempt,computeremployeeswhosatisfythecompensationrequirementsmustalsohaveaprimarydutythatconsistsof:(1)Theapplicationofsystemsanalysistechniquesandprocedures,includingconsultingwithusers,todeterminehardware,softwareorsystemfunctionalspecifications;(2)Thedesign,development,documentation,analysis,creation,testingormodificationofcomputersystemsorprograms,includingprototypes,basedonandrelatedtouserorsystemdesignspecifications;(3)Thedesign,documentation,testing,creationormodificationofcomputerprogramsrelatedtomachineoperatingsystems;or(4)Acombinationoftheaforementionedduties,theperformanceofwhichrequiresthesamelevelofskills.(29C.F.R.541.400).Anycomputeremployeewhomeetstheapplicablecompensationrequirementsandtheabovedutiestestqualifiesasanexemptcomputerprofessionalunderbothsection13(a)(1)andsection13(a)(17)oftheFairLaborStandardsAct.(FieldAssistanceBulletinNo.2006-3(Dec,14,2006)).Accordingly,thiswagedeterminationwillnotapplytoanyexemptcomputeremployeeregardlessofwhichofthesetwoexemptionsisutilized.2)AIRTRAFFICCONTROLLERSANDWEATHEROBSERVERS-NIGHTPAY&SUNDAYPAY:Ifyouworkatnightaspartofaregulartourofduty,youwillearnanightdifferentialandreceiveanadditional10%ofbasicpayforanyhoursworkedbetween6pmand6am.Ifyouareafull-timeemployed(40hoursaweek)andSundayispartofyourregularlyscheduledworkweek,youarepaidatyourrateofbasicpayplusaSundaypremiumof25%ofyourbasicrateforeachhourofSundayworkwhichisnotovertime(i.e.occasionalworkonSundayoutsidethenormaltourofdutyisconsideredovertimework).
