KITTITAS COUNTY <br />PUBLIC WORKS STUDY SESSION MINUTES <br />COMMISSIONERS' AUDITORIUM, 205 WEST 5TH ROOM 109 <br />Regular Meeting <br />MONDAY 1:30 PM March 27, 2023 <br />Board members present: Chairman Cory Wright, and Commissioner Laura <br />Osiadacz. <br />Others: Mark Cook, Josh Fredrickson, Rebecca Cruse, Public Works; Dan <br />Carlson, Community Development Services; Neil Caulkins, Chris Horner, <br />Prosecuting Attorney's Office; No members of the public. <br />At 1:30PM Chairman Cory Wright opened the Public Works Study Session. <br />No Citizen Comments. <br />At 1:31PM the Board of County Commissioners announced they would <br />recess into Executive Session for 5 minutes with Mark Cook, Chris <br />Horner, and Neil Caulkins per RCW 42.30.110 (i) To discuss with legal <br />counsel representing the agency matters relating to agency <br />enforcement actions, or to discuss with legal counsel representing <br />the agency litigation or potential litigation to which the agency, <br />the governing body, or a member acting in an official capacity is, or <br />is likely to become, a party, when public knowledge regarding the <br />discussion is likely to result in an adverse legal or financial <br />consequence to the agency. <br />At 1:36PM the Board of County Commissioners reconvened out of <br />Executive Session requesting an additional 5 minutes for discussion. <br />At 1:44PM reconvened out of Executive Session with direction to <br />challenge the claim and follow-up on laws related. <br />LAND USE MORATORIUM IN ELK MEADOWS DISCUSSION <br />Mark Cook briefed the Board of County Commissioners on the non- <br />compliant condition. of McElroy Bridge and the risks associated with <br />current use. Mark Cook stated that at the time of failure it was <br />temporarily repaired, and conditional use of the bridge was for a <br />limited time. Staff requested direction to place a land use <br />moratorium for 6 months on the properties reliant on the McElroy <br />Bridge while issues are addressed. Arden Thomas stated she has spoken <br />with FE[S.A and Washington State Military Fund to gain insight into <br />buyout programs and time constraints associated with those at -risk <br />properties. Neil Caulkins briefed the Board on the risk of continued <br />building in an area reliant on the non-compliant structure and that a <br />moratorium on building until a viable bridge is brought up to code <br />reduced risk. The Board directed Staff to bring forward legislation <br />for discussion. <br />2023-3-27 MINUTES <br />
