13166,ImprovingAccesstoServicesforPersonswithLimitedEnglishProficiency(August11,2000),requiresfederalagenciestoissueguidancetorecipients,assistingsuchorganizationsandentitiesinunderstandingtheirlanguageaccessobligations.DHSpublishedtherequiredrecipientguidanceinApril2011,DHSGuidancetoFederalFinancialAssistanceRecipientsRegardingTitleVIProhibitionAgainstNationalOriginDiscriminationAffectingLimitedEnglishProficientPersons,76Fed.Reg.21755-21768,(April18,2011).TheGuidanceprovideshelpfulinformationsuchashowarecipientcandeterminetheextentofitsobligationtoprovidelanguageservices,selectinglanguageservices,andelementsofaneffectiveplanonlanguageassistanceforLEPpersons.Foradditionalassistanceandinformationregardinglanguageaccessobligations,pleaserefertotheDHSRecipientGuidanceathttps://www.dhs.gov/quidance-published-help-department-supported-organizations-provide-meaningful-access-people-limitedandadditionalresourcesonhttps://www.lep.gov.9.NIMSCOMPLIANCEa.TheNationalIncidentManagementSystem(NIMS)identifiesconceptsandprinciplesthatanswerhowtomanageemergenciesfrompreparednesstorecoveryregardlessoftheircause,size,location,orcornplexity.NIMSprovidesaconsistent,nationwideapproachandvocabularyformultipleagenciesorjurisdictionstoworktogethertobuild,sustain,anddeliverthecorecapabilitiesneededtoachieveasecureandresilientnation.b.ConsistentimplementationofNIMSprovidesasolidfoundationacrossjurisdictionsanddisciplinestoensureeffectiveandintegratedpreparedness,planning,andresponse.NIMSempowersthecomponentsoftheNationalPreparednessSystem,arequirementofPresidentialPolicyDirective8,toguideactivitieswithinthepublicandprivatesectoranddescribestheplanning,organizationalactivities,equipping,training,andexercisingneededtobuildandsustainthecorecapabilitiesinsupportoftheNationalPreparednessGoal.c.InordertoreceivefederalpreparednessfundingfromtheDepartment,theSubrecipientmustachieve,orbeactivelyworkingtoachieve,alloftheNIMSImplementationObjectiveslocatedathttps://www.fema.qov/emergency-managers/nimslimplementation-training.B.EMPGPROGRAMSPECIFICREQUIREMENTSTheDepartmentreceivesEMPGfundingfromDHS/FEMA,toassiststate,local,andtribalgovernmentstoenhanceandsustainall-hazardsemergencymanagementcapabilitiesasauthorizedbyRobertT.StaffordDisasterReliefandEmergencyAssistanceAct,asamended(42U.S.C.§§5121etseq.)andSection662ofthePostKatrinaEmergencyManagementAct(6U.S.C.§762).ApodionofthegrantprogramispassedthroughtolocaljurisdictionsandtribeswithemergencymanagementprogramstosupplementtheirlocalltribaloperatingbudgetstohelpsustainandenhanceemergencymanagementcapabilitiespursuanttoWashingtonAdministrativeCode(WAC)118-09.a.TheSubrecipientshallusetheEMPGfundsauthorizedunderthisAgreementonlytoperformtasksasdescribedintheWorkPlanoftheSubrecipient'sapplicationforfunding,asapprovedbytheDepartmentandincorporatedintothisAgreement.b.Fundingmaynotbeusedtoreplaceorsupplantexistinglocalortribalgovernmentfundingofemergencymanagementprograms.c.TheSubrecipientshallprovideafiftypercentcashmatchofnon-federalorigin.TheFederalshareappliedtowardtheEMPGbudgetshallnotexceedfiftypercentofthetotalbudgetassubmittedandapprovedintheapplicationanddocumentedintheBudget(AttachmentF).Tomeetmatchingrequirements,theSubrecipient'scashmatchingcontributionsmustbeverifiable,reasonable,allowable,allocable,andnecessaryunderthegrantprogramandmustcomplywithallFederalrequirementsandregulations,including,butnotlimitedto,2CFRPad200.Anappropriatemechanismmustbeinplacetocapture,track,anddocumentmatchingfunds.Inthefinalreport,theSubrecipientshallidentifyhowthematchwasmetanddocumented.DHS-FEMA-EMPG-FY22Page9of39KittitasCounty,E23-184
