SubcontractorsonPublicBuildingorPublicWorkFinancedinWholeorinPartbyLoansorGrantsfromtheUnitedStates").TheActprovidesthateachcontractororSubrecipientmustbeprohibitedfrominducing,byanymeans,anypersonemployedintheconstruction,completion,orrepairofpublicwork,togiveupanypadofthecompensationtowhichheorsheisotherwiseentitled.Thenon-federalentitymustreportallsuspectedorreportedviolationstothefederalawardingagency.5)ContractWorkHoursandSafetyStandardsAct(40U.S.C.3701-3708).Whereapplicable,allcontractsawardedbythenon-federalentityinexcessof$100,000thatinvolvetheemploymentofmechanicsorlaborersmustincludeaprovisionforcompliancewith40U.S.C.3702and3704,assupplementedbyDepartmentofLaborregulations(29CFRPad5).Under40U.S.C.3702oftheAct,eachcontractormustberequiredtocomputethewagesofeverymechanicandlaboreronthebasisofastandardworkweekof40hours.Workinexcessofthestandardworkweekispermissibleprovidedthattheworkeriscompensatedatarateofnotlessthanoneandahalftimesthebasicrateofpayforallhoursworkedinexcessof40hoursintheworkweek.Therequirementsof40U.S.C.3704areapplicabletoconstructionworkandprovidethatnolaborerormechanicmustberequiredtoworkinsurroundingsorunderworkingconditionswhichareunsanitary,hazardousordangerous.Theserequirementsdonotapplytothepurchasesofsuppliesormaterialsorarticlesordinarilyavailableontheopenmarket,orcontractsfortransportationortransmissionofintelligence.6)RightstoInventionsMadeUnderaContractorAgreement.Ifthefederalawardmeetsthedefinitionof"fundingagreement"under37CFR§401.2(a)andtherecipientorSubrecipientwishestoenterintoacontractwithasmallbusinessfirmornonprofitorganizationregardingthesubstitutionofparties,assignmentorpedormanceofexperimental,developmental,orresearchworkunderthat"fundingagreement,"therecipientorSubrecipientmustcomplywiththerequirementsof37CFRPart401,"RightstoInventionsMadebyNonprofitOrganizationsandSrnallBusinessFirmsUnderGovernmentGrants,ContractsandCooperativeAgreernents,"andanyimplementingregulationsissuedbytheawardingagency.7)CleanAirAct(42U.S.C.7401-7671q.)andtheFederalWaterPollutionControlAct(33U.S.C.1251-1387),asamended-Contractsandsubgrantsofamountsinexcessof$150,000mustcontainaprovisionthatrequiresthenon-federalawardtoagreetocomplywithallapplicablestandards,ordersorregulationsissuedpursuanttotheCleanAirAct(42U.S.C.7401-7671q)andtheFederalWaterPollutionControlActasamended(33U.S.C.1251-1387).ViolationsmustberepodedtothefederalawardingagencyandtheRegionalOfficeoftheEnvironmentalProtectionAgency(EPA).8)DebarmentandSuspension(ExecutiveOrders12549and12689)-Acontractaward(see2CFR180.220)mustnotbemadetopartieslistedonthegovernment-wideexclusionsintheSystemforAwardManagement(SAM),inaccordancewiththeOMBguidelinesat2CFR180thatimplementExecutiveOrders12549(3CFRpad1986Comp.,p.189)and12689(3CFRpart1989Comp.,p.235),"DebarmentandSuspension."SAMExclusionscontainsthenamesofpartiesdebarred,suspended,orotherwiseexcludedbyagencies,aswellaspartiesdeclaredineligibleunderstatutoryorregulatoryauthorityotherthanExecutiveOrder12549.9)ByrdAnti-LobbyingAmendment(31U.S.C.1352)-Contractorsthatapplyorbidforanawardexceeding$100,000mustfiletherequiredcertification.Eachtierceltifiestothetierabovethatitwillnotandhasnotusedfederalappropriatedfundstopayanypersonororganizationforinfluencingorattemptingtoinfluenceanofficeroremployeeofanyagency,amemberofCongress,officeroremployeeofCongress,oranemployeeofamemberofCongressinconnectionwithobtaininganyfederalcontract,grantoranyotherawardcoveredby31U.S.C.1352.Eachtiermustalsodiscloseanylobbyingwithnon-federalfundsthattakesplaceinconnectionwithobtaininganyfederalaward.Suchdisclosuresareforwardedfromtiertotieruptothenon-federalaward.10)Procurementofrecoveredmaterials--Asrequiredby2CFR200.323,anon-federalentitythatisastateagencyoragencyofapoliticalsubdivisionofastateanditscontractorsmustcomplywithsection6002oftheSolidWasteDisposalAct,asamendedbytheResourceConservationandRecoven;Act.TherequirementsofSection6002includeprocuringonlyitemsdesignatedinguidelinesoftheEnvironmentalProtectionAgency(EPA)at40CFRpartDHS-FEMA-EMPG-FY22Page14of39KittitasCounty,E23-184
