6. <br />5.3 Applicable Law: <br />This LEASE is made pursuant to Chapter 2.81 KCC and is subject to the provisions of <br />Chapter 59.l2 RCW, each as now or hereafter amended, provided, however, that no such <br />amendment shall modiS, any of the substantive tenns hereof. <br />IMPROVEMENTS: <br />6.1 Authorized Improvements: <br />Lessee has the right to construct or maintain a private aircraft hangar and other aviation- <br />related improvements on the premises as specified in Exhibit C. All buildings, trade <br />fixtures and other improvements to the leased propefiy by LESSEE shall conform to <br />applicable rules, regulations, building and fire codes, and will comply with the Minimum <br />Standards for private hangars at the Kittitas County Airport (Kittitas County Code Title <br />19 as cun'ently existing or as modified). LESSEE shall procure allbuilding and other <br />permits required by law prior to commencement of building, All buildings trade fixtures <br />and other improvements shall be designed with a view toward aesthetic considerations <br />and installation shall not commence untilplans and specifications therefore have been <br />submitted to and approved in writing by the County, which approval shall not be <br />unreasonably withheld. <br />6.2 LESSOR'SRepresentations/requirementsrelatedto ground: <br />LESSOR makes no representation or guarantee as to the suitability of the leased area for <br />construction of buildings, roads, ralnps, etc., and is not responsible for the costs of <br />excavation and/or removal ofany object found either above or below ground level except <br />for hazardous materials and archaeological artifacts existing prior to tenancy. <br />6.3 Title to Improvements: <br />During the term of this Lease, provided LESSEE is not in default, all porlions of the <br />Improvements shall be and remain the property of the LESSEE regardless of its status for <br />tax purposes as being real or personal property. <br />6.4 Disposition of Improvements upon Termination: <br />Upon termination of this lease, except as stated in sections 6.4.1,6.4.2, all irnprovements <br />remaining upon the leased premises become the property of LESSOR, free and clear, <br />without any liability of LESSOR to LESSEE.
