SECTION7:RESPONSIBILITIESOFEACHPARTY7.1ResponsibilitiesofSubrecipient:ThisprojectitselfisthesoleresponsibilityofSubrecipient.MLEundedakesnoresponsibilitiestoSubrecipient,ortoanythirdparty,otherthanasexpresslysetoutinthisdocument.Subrecipientshallbesolelyresponsibleforthedesign,development,implementation,achievementofdeliverablesandreportingoftheproject,asthosephasesareapplicabletothisproject,andsolelyresponsibleforanyclaimorsuitofanynaturebyanythirdpartyrelatedinanywaytotheproject.7.1.1ProjectTimeline.TheSubrecipientisresponsibleformaintainingtheprojecttimelineforalldatesandactivitiesoutlinedastheSubrecipient'sresponsibilityasidentifiedintheSubrecipient'sFFAGrantApplication(Attachment"A").TheSubrecipientshallcompletetheapprovedprojectnolaterthanSeptember30,2023,asatermoftheacceptanceofthisgrantaward.Theprojecttimelinecannotbeextendedunderthescopeofthisagreement.MLEstaffshallmonitortheactivitiesconductedunderthescopeofthisprojectonaquarterlybasis.Workwillbeconsideredcomplete,onlywhenthefollowingconditionsaremet:•TheactivitiesdescribedintheScopeofWorkandthisgrantdocumenthavebeenachieved.•Allrequestforreimbursementshavebeensubmitted.•AllreportingthroughtheMLEStatementofActivityReportingsystem(SOAR)andSECTORhavebeencompleted•AppropriateproofofcompletionhasbeenprovidedtoMLEIftheworkisnotsatisfactorilycompleted,SubrecipientwillbeinbreachandMLEmay,atitsdiscretion,rescindthegrantandrequirerepaymentofanygrantfundsalreadydisbursed.7.1.2DesignPreparation.TheSubrecipientshalldesignaprojectthatwillhaveareasonablylikelihoodofpositivelyimpactingthereductionofboatingaccidents,boatinginjuries,andboatingfatalities.SuchdesignshallincludeapplicableitemsontheChecklistforPlansandSpecificationsasprovidedintheSubrecipient'sMLEGrantApplication(Attachment"A").7.1.3Purchase.TheSubrecipientshallmakenopurchasesinexcessof$2,500.00withoutpriorwrittenauthorizationbyMLE.AllpurchasesmustbeinthefurtheranceofrecreationalboatingsafetyandmustadheretotheguidelinessetoutintheintheAllowableCostsandExpendituresforStateVesselRegistrationFeesandFederalAssistanceGrantsmanual.(Attachment"B").7.1.4PeriodicInspections.SubrecipientherebygrantstotheRecipient,oritsauthorizedrepresentative,aright,equalintimetosixyearsfromthedateofthelastsignatureonthisdocument,toenteruponSubrecipient'spropertyasdeemednecessarybytheRecipientforinspectiondocumentsandanyequipment.Theseperiodicinspectionsareintendedtoensurecontinuedcompliantuseoftheawardedfundstowardrecreationalboatingsafetyenforcementandeducation.materials,products,andworkmanshiptotheoriginalapprovedplansandspecifications.Theseinspectionsrequirea30-dayadvancenotificationtotheSubrecipientofsuchinspectionoraccess.MLE123-407SubrecipientAgreement-BoatingProgram(FFAGrantAward)Page4of35
