2021 Docket Enabling Ordinance December 20, 2022 <br />Page 36 <br /> <br /> <br />Exhibit H: Docket Item 22-09 <br /> <br />Structure Setbacks for Retaining Walls and Overhang <br />Setback Encroachment <br /> <br />17.08.520 Structure. <br />"Structure" means that which is built or constructed, an edifice or building of any kind, or any place <br />of work artificially built up or composed of parts joined together in some definite manner. Fences <br />that are 7 feet or less in height, and retaining walls that are 4 feet or less in height measured from <br />the bottom of the footing to the top of the wall not supporting a surcharge or impounding Class I, II <br />or III-A liquids are excluded from this definition. <br />17.08.580 Yard depth. <br />"Yard depth" means the minimum perpendicular distance between any point on a lot line and the <br />nearest part of any structure or building, excluding an 18-inch eave (overhang) no closer than 5 feet <br />to the property line, and excluding retaining walls necessary for access permits as determined by <br />Kittitas County Public Works. <br />
