DISPUTES <br />In the event that a dispute arises under this Agreement, it will be determined by a Dispute Board in <br />the following manner: Each party to this Agreement will appoint one member to the Dispute Board. <br />The members so appointed will jointly appoint an additional member to the Dispute Board. The <br />Dispute Board will review the facts, Agreement terms and applicable statutes and rules and make a <br />determination of the dispute. The Dispute Board will thereafter decide the dispute with the majority <br />prevailing. The determination of the Dispute Board will be final and binding on the parties hereto. As <br />an alternative to this process, either of the parties may request intervention by the Governor, as <br />provided by RCW 43.17.330, in which event the Governor's process will control. <br />14. INSURANCE <br />HCA certifies that it is self-insured under the State's self-insurance liability program, as provided by <br />RCW 4.92.130, and shall pay for losses for which is found liable. <br />The Contractor certifies by signing this Contract that either: <br />14.1. The Contractor is self-insured or insured through a risk pool and shall pay for losses for <br />which it is found liable, or <br />14.2. The Contractor maintains the types and amounts of insurance identified below and shall, if <br />requested by HCA; provide certificates of insurance to that effect to the HCA contact on <br />page one of the Agreement. <br />14.2.1. General Liability Insurance <br />The Contractor shall maintain Commercial General Liability Insurance, or <br />Business Liability Insurance, including coverage for bodily injury, property <br />damage, and contractual liability, with the following minimum limits: Each <br />Occurrence - $1,000,000; General Aggregate - $2,000,000. The policy shall <br />include liability arising out of premises, operations, independent contractors, <br />products -completed operations, personal injury, advertising injury, and liability <br />assumed under an insured contract. The State of Washington, HCA, and elected <br />and appointed officials, agents, and employees of the state, shall be named as <br />additional insureds. <br />In lieu of general liability insurance mentioned above, if the Contractor is a sole <br />proprietor with less than three contracts, the Contractor may choose one of the <br />following three general liability policies but only if attached to a professional <br />liability policy, and if selected the policy shall be maintained for the life of this <br />Contract: <br />Supplemental Liability Insurance, including coverage for bodily injury and <br />property damage that will cover the Contractor wherever the service is performed <br />with the following minimum limits: Each Occurrence - $1,000,000; General <br />Aggregate - $2,000,000.
