4.18 NOTTCES
<br />The Subrecipient shall omply with all public notices or notices to individuals required by applicable local,
<br />state and bderallaws and rcgulations and shall maintain a record of this compiiance.

<br />The Subrecipient represents and wanants that its woftplace does now or will meel all appticable federal
<br />and state safety and health regulations thal are in effed during the Subreciplent's performince under this
<br />Agregment. To the extent allowed by law, the Subrecipient further agrees to indeninlfy and hold harmless
<br />lhe. Department and its employees-and agents from all liabillg, damages and c6sts of any nature,
<br />inclu.ding, but not limited to, costs of suits and atlorneys' fees a-ssesseO against the Dapanmlnt, as a
<br />result of the failure olthe Subrecipientto so compg.
<br />A,2O OVIJNERSHIP OF PROJECT/CAPITAL FACILITIES
<br />The Department makes no claim to any capitalfacililies or real property improrred or constructed wilh
<br />funds under this. Agreement, and by this subarvard of funds does notand will-not acquire any ownership
<br />interest or title to suctt property of the Subrecipient. The Subrecipient shall assume all liibilities and
<br />responsibilitiesarising fiom lhe ownership and operalion of the project ard agrees to lndemnify and hotd
<br />the Department, the state of Washington, and the United States gbvernmenl harmless from any and all
<br />causes of aclion arising from lhe ownership and operation of the Froi""t.
<br />A.21 POLITICALACTIVITY
<br />N.o portion of the funds provided herein shall be used for any partisan political activtty or to turther the
<br />elec'tion or defeat of any clndidale for public office or influenci ihe approval or defeat of any baltot issue.
<br />4.22 pFOrUrynOru ncnnsl
<br />The asslstance pro-vided under this Agreemenl shall not be use'd in payment of any bonus or commission
<br />for the purpose 9f o_plainlrE approval of lhe apptication for sudr assistance or any other approvat or
<br />ooncunence under this Agreement provided, holever, that reasonable fees or 6ona ftdi iechnical
<br />consultant, managerial, or other such services, other than ac{ual solicitation, are not hereby prohibited if
<br />othenrvise eligible as project costs.
<br />4.23 PUFLIC|TY
<br />The Subrecipient agrees lo submit to the Department prior to issuance all advertising and publicity
<br />matters relating lo.lhis Agryenpnt wherein the Department's name is mentioned, or language uieO frorir
<br />which the connedign- of the Department's name may, in the Depadmenfs judgmeni, bE inferred or
<br />implied. The Subrecipient agrees not to publish or use such advertising and pubticlty matters without theprior written consenl.of the Departnent. The Subrecipient may copyright odlinal w6* n develops in the
<br />course of or underthis Agreement; however, pursuanl to 2 CFR Part 200.315, FEMA reserves d royalty-
<br />free, nonexclusive, and inevocable license to reproduee, publish or olhenrlse use, and to authoriie
<br />others to use the work for govemment purposes.
<br />Publication refllting from-wotk pgrfq,rmed under this Agreement shall indude an acknowledgement of
<br />FEMA's financial supporl, by the Assistance Listings Number (formerly CFDA Number), and a-s.tatement
<br />that the publication doas not constitute an endorsement by FEMA or raflea FEMA'6 vitir,ys.
<br />A.24 RECAPTURE PROV|S|ON
<br />ln the event the Subrecipient fails to expend funds under this Agreement in accordanoe with appl6ab6
<br />federal, state, 91! local laws,_regulations, ard/or the provislons of the Agreement, the Deiirtment
<br />reserves the righ!.to recapturefunds in an amount equivalent to the extent of noncompliance. Such right
<br />of recapture shall sxist fur the lih of the projec't following Agreement termination. Repayment Uy fre
<br />Subrecipienl of funds under thls recapture provision shall occur within 30 days of demahO. tn the 6ventthe tlepartment is required to institute legal procaedings to enforce trd recapture provision, the
<br />pepartmgnt shall be entitled to its costs and expenses thereol induding attdmey iees ftom the
<br />Subrecipient.
<br />4.26 RECORDSa. The Subreciplent agrees to malntain all books, records, documents, receipts, involces and all
<br />other eleclronic or wdtten records necessary to suffdenfly and propedy refreA me Subrecipienfs
<br />contrads, subawards, grant administration, and payments, including all dkecl and indirect
<br />charges, and expendlhrres in the performance of this Agreement (the'6cords).
