c.subjecttootheroutgrantsoftheUnitedStatesonthepremises.d.personaltothegrantee,andthislicense,oranyinteresttherein,maynotbetransferredorassigned.8.CONDITIONOFPREMISESThegranteeacknowledgesthatithasinspectedthepremises,knowsitscondition,andunderstandsthatthesameisgrantedwithoutanyrepresentationsorwarrantieswhatsoeverandwithoutanyobligationonthepartoftheUnitedStates.9.COSTOFUTILITIESThegranteeshallpaythecost,asdeterminedbytheofficerhavingimmediatesupervisionoverthepremises,ofproducingand/orsupplyinganyutilitiesandotherservicesfurnishedbytheGovernmentorthroughGovernment-ownedfacilitiesfortheuseofthegrantee,includingthegrantee'sproportionateshareofthecostofoperationandmaintenanceoftheGovernment-ownedfacilitiesbywhichsuchutilitiesorservicesareproducedorsupplied.TheGovernmentshallbeundernoobligationtofurnishutilitiesorservices.Paymentshallbemadeinthemannerprescribedbytheofficerhavingsuchjurisdiction.10.PROTECTIONOFPROPERTYThegranteeshallkeepthepremisesingoodorderandinaclean,safeconditionbyandattheexpenseofthegrantee.ThegranteeshallberesponsibleforanydamagethatmaybecausedtopropertyoftheUnitedStatesbytheactivitiesofthegranteeunderthislicense,andshallexerciseduediligenceintheprotectionofallpropertylocatedonthepremisesagainstfireordamagefromanyandallothercauses.AnypropertyoftheUnitedStatesdamagedordestroyedbythegranteeincidenttotheexerciseoftheprivilegeshereingrantedshallbepromptlyrepairedorreplacedbythegranteetoaconditionsatisfactorytosaidofficer,orattheelectionofsaidofficer,reimbursementmadethereforebythegranteeinanamountnecessarytorestoreorreplacethepropertytoaconditionsatisfactorytosaidofficer.11.INDEMNITYTheUnitedStatesshallnotberesponsiblefordamagestopropertyorinjuriestopersonswhichmayarisefromorbeincidenttotheexerciseoftheprivilegeshereingranted,orfordamagestothepropertyofthegrantee,orfordamagestothepropedyorinjuriestothepersonofthegrantee'sofficers,agents,oremployeesorotherswhomaybeonthepremisesattheirinvitationortheinvitationofanyoneofthem,andthegranteeshallholdtheUnitedStatesharmlessfromanyandallsuchclaimsnotincludingdamagesduetothefaultornegligenceoftheUnitedStatesoritscontractors.
