The construction drawings at the time identify the area occupied by the previous <br />road alignment and right-of-way which was not used for construction as to be vacated <br />and the easement relinquished to the property owner. This right-of-way vacation and <br />easement relinquishment appears to not have been finalized at that time. <br />In 2008 a non-exclusive water and sewer franchise was granted to Northland <br />Investments. This franchise agreement allows for water and sewer lines to be installed in <br />the White Road right-of-way to serve development near the Creekside Road area. The <br />franchise granted includes the area of White Road right-of-way which was not <br />constructed. Utility work to install a water main in the right-of-way was done in the first <br />half of 2022. <br />Public Works received a request from the adjacent property owner to vacate the <br />unconstructed portion of White Road right-of-way and the area occupied by the previous <br />alignment. <br />DISCUSSION: <br />The requested vacation allows the adjoining parcel to no longer be burdened by the right- <br />of-way. PW is proposing that no value be assigned to the right-of-way as no public <br />improvements have been created in a portion of the right-of-way. The portion of right-of- <br />way which had road improvements are no longer in use as the 2003 construction project <br />realigned the roadway. A subsequent record of survey by the property owners will clear <br />title and allow full use of the proponent's property.
