andprovideandensureappropriatepersonalflotationdevicesarewornatalltimeswhenonthevesselordock.12.5.5Alllawenforcementvesselsshallhavearoutinescheduleformaintenance.12.5.6Asaconditionofreceivingthegrantfunds,Subrecipientshallactivelymaintainthevesselforthefulldesignlifeoftheequipmentprovidedfromthisgrant.12.5.7Subrecipientshallberesponsibleforalloperation,maintenance,andrepairofallvesselsandequipmentprovidedfromthisgrant.12.6EquipmentReplacement.WhenoriginalorreplacementequipmentacquiredunderthisawardisnolongerneededortheSubrecipientisnolongerabletosupporttheRBSmissionandthedispositionoccursduringthegrantperiod,dispositionoftheequipmentshallbemadeasfollows:•Theequipmentmaybetransferredatnocosttoanotherlawenforcementagencywithastateparksapprovedmarinelawenforcementprogram(e.g.,cityorcountylawenforcementagency)ifsuchequipmentwillremaininuseandbededicatedtotheMLEprogram.TheconditionsforsuchtransfershallbestipulatedbytheMLEandshallincludethesamerequirementsasthoseimposedintheoriginalgrant.Anycashorin-kindmatchpaidwhentheequipmentwasoriginallypurchasedwillbeforfeitedintotal.•Iftheequipmentcannotbetransferredtoanotherlawenforcementagencywithastateapprovedmarinelawenforcementprogram,itmustbesoldatthediscretionoftheMLE,andtheSubrecipientshallpayMLEtheproceedsofthesaleorthefairmarketvalueoftheequipment,whicheveristhegreatest.12.6.1EquipmentBreakdownIntheeventanequipmentbreakdownoccursduringthegrantperiod,SubrecipientshallnotifyMLEwithinten(10)workingdaysofbreakdown.Theequipmentmustberepairedandfullyoperationalwithinthirty(30)workingdaysafterthebreakdownwherethebreakdowncanberemediedwithnormalexpectedrepairsforonethousanddollars($1000)orless.Forrepairsgreaterthanonethousanddollars($1000)theequipmentmustbefullyoperationalwithinsixty(60)daysafterthebreakdown.AwrittenreportforallbreakdownsmustbesubmittedviaemailtoMLEwithintwo(2)weeksofthebreakdowndescribingtheproblem(s),repair(s),andthecost(s).AfailuretonotifyMLEofanequipmentbreakdownandplanforrepairsmayresultinthewithholdingofgrantfunds.12.7AccidentReportSubrecipientsorSubrecipient'sstaffinvolvedinanaccidentmustremainatthesceneandassistanyothervesselorpersoninvolved,ifpossible,withoutendangeringtheirsafety,theirownvesselorthepeopleaboard.SECTION13:OWNERSHIPOFWORKPRODUCTMLE123-122SubrecipientAgreement-BoatingProgram(FFAGrantAward)Page14of64
