12.2Title.TitletoequipmentpurchasedunderthisAgreementshallvestintheSubrecipient.IftheSubrecipientdeterminesthatitcannotusetheequipmentforthestatedgrantpurposesatanypointpriortotheendoftheequipment'susefullife,butaftertheendofthisawardperiodandanyextensionsthereof,theSubrecipientshallinformMLEinwritingwithin30daysofsuchdetermination.SuchequipmentshallbetransferredbytheSubrecipienttoathirdpartyapprovedbyMLEforuseforgrantpurposesinaccordancewithapplicableprovisionsofstateandfederallaw.ShouldtheequipmentnotbetransferredtoanotherstateparksRBSapprovedlawenforcementagencyinaccordancewiththisprovision,theequipmentshalleitherbereturnedtoMLEforuseforgrantpurposes,oritshallbedisposedinaccordancewith50CFRPart85;and2CFRPart200.12.3UsefulLife.Beyondtheacquisitiongrantperiodofperformanceandthroughoutthedurationoftheequipment'susefullife,theequipmentmustcontinuetobeusedintheprogramorprojectforwhichitwasacquired,asRecreationalBoatingSafetyActProgram.Whennolongerneededfortheoriginalprogramorproject,equipmentmaybeusedinotheractivitiesinthefollowingorderofpriority:a.ActivitiessupportedunderaFederalawardfromtheFederalawardingagencywhichfundedtheoriginalprogramorproject;thenb.ActivitiesunderFederalawardsfromotherFederalawardingagencies;thenc.AnyactivitiesconsistentwiththeadministrationoftheWashingtonStateParksandRecreationCommission.12.4SpecialSurvivorshipNote:Ownershipisnotabsolute.Regardlessofagreement'sexpiration,anythingtangible,intangible,orintellectualpropertythatwaspurchasedorcreatedfromfederalfundsorfundedwithfederalfundsmaintainsfederalandstateMLEentanglements,requirements,orconditions(conditionalownership)unlessluntilreleasedbytheMLEorfederalgovernmentinwriting.Whileotherconditionsmayapply,typicallyareleasewouldoccurupontheMLEorfederalgovernmentbeingcompletelysatisfiedthattheiteminquestionhasreachedtheendofitsusefullifewhichisusuallyadollarvalue.DeterminationofvalueissolelyatthediscretionoftheMLEorfederalgovemment.Shouldprofessionalappraisalservicesbeneededtodeterminevalue,thesecostsshallbebomebytheSubrecipient.SelectionofanappraisalservicesfirmissubjecttothewrittenapprovaloftheMLEorfederalgovernment.12.5UseandMaintenance.TheSubrecipientshalloperateandmaintaintheequipment,purchased,constructed,installed,renovated,operated,repaired,ormaintainedwithMLEgrantfundstofunctionasintendedforthefullperiodoftheirusefullifeandinamannerthatprovidesadequateservice,promotesuse,andprotectspublichealth.Suchconditionsinclude:12.5.1SubrecipientshalloperateandmaintaingrantfundedequipmentinaccordancewithallapplicableFederal,Stateandlocallaws,orders,regulationsandpermits.12.5.2Operationshallincludehavingtrainedpersonnelavailabletofacilitateoperationoftheequipmentandascheduleformaintenance.12.5.3LawEnforcementvesselsshallbeoperatedbytrainedpersonnelwithavalidStateofWashingtonBoaterEducationCardorequivalentandbeagraduateofstateparksBasicMarineLawEnforcementAcademyorequivalent.12.5.4LawEnforcementvesselsshallbeequippedwithallfederallyrequiredsafetyequipmentMLE123-122SubrecipientAgreement-BoatingProgram(FFAGrantAward)Page13of64
