B0WER$ Ftffi6-sl KET-f f, TAS COt.'$ITY AI RPOR <br />by financially disadvantaged persons; shall have the maximum opportunity to <br />participate in the performance of Agreements as defined in 49 CFR Section 23.5. <br />Consequently, this Agreement is subject to 49 CFR Part 23 as applicable. <br />LESSEE hereby assures that no person shall be excluded from participation in, <br />denied the benefits of or othenrvise discriminated against in connection with the <br />award and performance of any contract, including leases and agreements, covered <br />by 49 CFR Part 23 on the grounds of race, color, national origin or sex. <br />LESSEE hereby assures that it will include the above clauses in all sub-leases and <br />cause sub-tenants to similarly include clauses in further sub-leases or partial <br />assignments. <br />12. BINDING EFFECT AND BENEFIT. <br />This LEASE shall be binding upon and inure to the benefit of the parties hereto, <br />their successors, assigns, partial assigns and subtenants. <br />13. ESTOPPEL CERTIFICATES. <br />LESSOR shall issue estoppel certificates to tenants, partial assignees, assignees, <br />and lenders of LESSEE upon request and in forms required by such tenants, <br />partial assignees, assignees, and lenders. LESSEE shall reimburse LESSOR for <br />its actual, reasonable out of pocket costs in providing same. <br />14. RULES AND REGULATIONS. <br />The LESSEE agrees to comply with all pertinent rules and regulations of the federal, <br />state and local governments, as well as the rules, regulations, ordinances, and <br />standards of the Kittitas County Airport (Bowers Field), as are presently in effect and <br />may in the future be adopted, and copies of which shall be provided to Tenant within <br />thirty (30) days of the Commencement Date. <br />15. IMPROVEMENTS. <br />All buildings, trade fixtures and other improvements to the leased property by <br />LESSEE shall conform to applicable rules, regulations, building and fire codes. <br />LESSEE shall procure all building and other permits therefore. All buildings trade <br />fixtures and other improvements shall be designed with a view toward aesthetic <br />considerations and installation shall not commence until plans and specifications <br />therefore have been submitted to and approved in writing by the Airport Director, <br />which approval shall not be unreasonably withheld. LESSOR makes no <br />representation or guarantee as to the suitability of the leased area for construction <br />of buildings, roads, ramps, etc., and is not responsible for the costs of excavation <br />and/or removal of any object found either above or below ground level except for <br />hazardous materials and archaeological artifacts existing prior to tenancy. <br />LESSEE INIT lAt LESSOR INITIA <br />PAGE 11
