ADMINISTRATIVE ANDIOR FINANCIAL REQUIREMENTS <br />The Subrecipient shall cgmply with all applicable state and federal laws, rules, regulations, requirements and <br />PlgQl?I guidance identified or referenced in this Agreement and the informationlt documenti published by <br />DHS/FEMA applicable to the 21EMPG Program, including, but not limited to, atl criteria, restric,tions, ani <br />requirements ol The Department of Hometand Security (DHS) Notice of Funding Opportunity (NOFO) Frscat <br />Year (FY) 2021 Emeryancy Management Pertormance Grant (EMP9) document, <br />'the fervtn'prcpaiedness <br />Grants Manual document (the Manual), the DHS Award LetterforGrant.No. EMS-2021-Ep-00007-50l, and the <br />!qO"E! rlgulations commonly applicableto DHS/FEMA grants, allof which are incorporated herein by reference. <br />The DHSAward Lefter is incorporated in this Agreement as Attachment c. <br />The Subrecipient acknowledges that since this Agreement involves federal award funding, the performance <br />pelod may begin prior t9 the availability of appropriated federal funds, The Subrecipient aliees that it wiil nothold the Department, the state of Washington, or the United States liable for any dimages, claim for <br />reimbursement, or any type of payment whatsoever for services performed under ttiis ngre6ment prior to <br />distribution of appropriated federal funds, or if federal funds are not appropriated or in a particillar amount. <br />A. STATE AND FEDERAL REQUIREMENTS FOR DHS/FEMA PREPAREDNESS GRANTS; <br />The following requirements apply to all DHS/FEMA Preparedness Grants administered by the <br />Department. <br />1, $UBAWARDS & CONTRACTS BY SUBRECIPIENTa. The Subrecipient must make a case-by-case determination whether each agreement it <br />makes for the disbursement of 21EMPG funds received under this Agreement casts the <br />party receiving the funds in the role of a subrecipient or contractor in-accordance with 2 <br />cFR 200.331. <br />b. lf the Subrecipient becomes a pass-through entig by making a subaward to a non-federal <br />entity as its subrecipient: <br />i. The Subrecipient must comply with allfederal laws and regulations applicable to <br />pass-through entities of 21EMPG funds, including, but not limited to, those <br />contained in 2 CFR 200. <br />ii.
