<br />KCHD ORDINANCE 1999- 5 SOLID WASTE REGULATIONS <br />Drop Box Facility: A facility used for the placement of a detachable container, including the area adjacent <br />for necessary entrance and exit roads, unloading and turnaround areas. Drop box facilities normally serve the <br />general public with loose loads and receive waste from off-site. Drop box facilities may also include <br />containers for separated recyclables. <br />Ecology: The Washington State Department of Ecology. <br />Emission: The release of air contaminants from solid waste into the outdoor atmosphere. <br />Energy Recovery: The recovery of energy in a usable form from mass burning or refuse derived fuel <br />incineration, pyrolysis or any other means of using the heat of combustion of solid waste that involves high <br />temperature (above 1,200 degrees Fahrenheit) processing. <br />EPA: The United States Environmental Protection Agency. <br />Existing Facility: A facility which is owned or leased, and in operation, or for which construction has begun, <br />on or before the effective date of Chapter 173-304 WAC and the owner or operator has obtained permits or <br />approvals necessary under federal, state and local statutes, regulations and ordinances. A facility has <br />commenced construction if either: <br />1. A continuous on-site physical construction program has begun; or <br />2. The owner or operator has entered into contractual obligations which cannot be canceled or modified <br />without substantial financial loss for physical construction of the facility to be completed within a <br />reasonable time. <br />Lateral extensions of a landfill's active area on land purchased and permitted by the Health Department for the <br />purpose of landfilling before the effective date of Chapter 173-304 WAC shall be considered existing facilities. <br />Expanded Facility: A facility adjacent to an existing facility for which the land is purchased and approved by <br />the Health Officer after the effective date of Chapter 173-304 WAC. A vertical expansion approved and <br />permitted by the Health Department after the effective date of Chapter 173-304 WAC shall also be considered <br />an expanded facility. <br />Extremely Hazardous Waste: Those dangerous and mixed wastes designated in WAC 173-303-100 as <br />extremely hazardous. The abbreviation “EHW” will be used in this ordinance to refer to those dangerous and <br />mixed wastes which are extremely hazardous <br />Facility: All contiguous land (including buffer zones) and structures, other appurtenances, and improvements <br />on the land used for solid waste handling. <br />Facility Structures: Buildings, sheds, utility lines and drainage systems on the facility. <br />Final Treatment: The act of processing or preparing solid waste for disposal, utilization, reclamation or other <br />approved method of use. <br />Garbage: Unwanted animal and vegetable wastes and animal and vegetable wastes resulting from the <br />handling, preparation, cooking and consumption of food, swill and carcasses of dead animals, and of such a <br />character and proportion as to be capable of attracting or providing food for vectors, except sewage and <br />sewage sludge.
