<br />2020 Solid Waste and Moderate <br />Risk Waste Management Plan Update <br /> <br />9-8 AX0304191054PDX <br />9.2.4 Illegal Dumping <br />The Health Department is responsible for undertaking investigations and enforcement action against <br />littering and illegal dumping throughout the County. <br />The following ordinances are in effect to cover illegal dumping (both hazardous and nonhazardous <br />wastes and substances): <br />KCC 8.20.010 Permitted areas. It is unlawful for any person to throw, drop, or to leave <br />any discarded object, debris, or any waste, upon any public or private property in this <br />County, or in any waste waters in this County, unless: <br />1. Such property is designated by the federal government, state, County or city/town <br />within Kittitas County for the disposal of garbage and refuse, and such person is <br />authorized to use such property for such purpose. <br />2. Into a litter receptacle or container installed on such property by any governmental <br />agencies described in subsection (1) of this section or installed with their consent. <br />3. He is the owner or a tenant in lawful possession of such property. <br />KCC 8.20.020 Penalty for violation. Any person violating any of the provisions of this <br />chapter shall be punished by a fine not more than one thousand dollars or by <br />imprisonment in the County jail for a period not exceeding ninety days. <br />KCC 9.50.155 Dumping in water prohibited. No person shall pollute, or in any way <br />contaminate by dumping or otherwise depositing therein any waste or refuse of any <br />nature, kind or description, including human or bodily waste, in any stream, river, lake or <br />other body of water running in, through, or adjacent to any Kittitas County park area. <br />Environmental Health first investigates calls from the general public regarding perceived illegal dumping. <br />If such reports are substantiated, they are then given to the Kittitas County Code Enforcement Officer for <br />enforcement action. Title 18 of the County Code identifies code enforcement, applicable penalties, and <br />how proceeds from penalties are distributed. <br />It is also the County Code Enforcement Officer’s responsibility to “enforce” the planning codes, building <br />codes and the environmental health codes (illegal dumping) within the County. The Code Enforcement <br />Officer is shared with Buildings, and Planning Departments and the Environmental Health Division of the <br />Public Health Department. <br />9.3 Ordinances <br />Solid waste handling standards are regulated under WAC 173-350, adopted in January 2003. County <br />Ordinance 1999-01 was adopted on July 15, 1999 (Appendix C). This ordinance does the following, <br />through the authority of Chapters 70.05 and 70.95 RCW: <br /> On-Site Solid Waste Management Standards. <br /> Solid Waste Collection Service Standards. <br /> Solid Waste Handling Facility Standards. <br />9.3.1 Needs <br />Responsibilities for implementing the Solid Waste Management Plan are assigned to various local <br />agencies. Since responsibilities for specific tasks are assigned to more than one agency, each of the <br />jurisdictions needs to recognize the importance of carrying out all tasks in a manner that ensures efficient <br />use of resources (by avoiding duplication of effort), avoids gaps in program activities, and avoids conflicts <br />or inconsistencies.
