Electronic Product Recycling Program <br /> Solid waste regulations adopted by local health authorities <br /> Local nuisance laws <br />9.2.2 Regulations Pertinent to Local Solid Waste Financial Assistance Grants <br />The rules that govern the eligibility for financial assistance are found in Chapter 173-312 WAC. WAC 173- <br />312-040(1) states: <br />“A local government with a department-approved solid waste plan that was developed <br />using a solid waste advisory committee (SWAC) as defined in WAC 173-312-020, that <br />has the primary responsibility for maintaining that plan, is eligible to apply for financial <br />assistance to help maintain the plan.” <br />WAC 173-312-040(3) also states: <br />“A local government with a department-approved hazardous waste plan, and that is <br />required by Chapter 70.105 RCW to adopt the local hazardous waste plan, and that <br />complies with coordination requirements as described in WAC 173-312-060(5)(b) is <br />eligible to apply for financial assistance to help maintain the plan . . .” <br />9.2.3 Permitting <br />Solid waste facility permits are required under Ordinance 1999-01, in accordance with Chapters 173-303, <br />173-350, and 173-351 WAC. Facilities are required to obtain solid waste handling permits from the Health <br />Department. The County’s covered load law is also included in Ordinance 1999-01. <br />The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental agencies to <br />consider the environmental impacts of a proposal before making decisions. An environmental impact <br />statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the <br />quality of the environment. To determine if an EIS is necessary, an environmental checklist must be <br />completed. For this planning document, a SEPA checklist has been completed and is included as <br />Appendix G. <br />Applicants applying for new solid waste permits within Kittitas County will notify the KCHD. The applicant <br />will submit a permit application (provided by KCHD) and a SEPA Application to KCHD, which in turn will <br />forward such applications to the Kittitas County Solid Waste Department (Solid Waste). <br />Solid Waste will request a meeting of the SWAC to review the permit application for conformance to the <br />Kittitas County Solid Waste Management Plan. <br />SWAC will review the documents for thoroughness in conforming to the Kittitas County Solid Waste <br />Management Plan. <br />SWAC will return their findings to the Health Department who will consider and include those findings in <br />their final decision. The Health Department will forward such findings and comments along with the SEPA <br />and Application, on to the Kittitas County Board of Health. <br />Final approval or disapproval of the application shall rest with Kittitas County Health Department, which <br />shall issue its approval/disapproval of the application within 90 days after its receipt pursuant to Chapter <br />70.95.180 RCW. <br />~ ~
