4. Delav in Mitiqation. The Director mav authorize a one-time temoorarv delav. up to one <br />hundred eighty (180) dalrs. in completing minor construction and landscaping when <br />environmental conditions could produce a hiqh probability of failure or sionificant construction <br />difficulties. The delav shall not create or perpetuate hazardous conditions or environmental <br />damaqe or deoradation. and the delav shall not be injurious to the health. safety. and qeneral <br />welfare of the public. The request for the temporarv delav must include a written justification <br />that documents the environmental constraints which preclude implementation of the <br />mitiqation plan. The iustification must be verified and approved bv the Countv and include a <br />financial quarantee. <br />5. Preference of Mitiqation Actions. Compensatorv wetland mitiqation shall occur in the <br />followinq order of preference: <br />a. Purchasinq credits from an approved Mitiqation Bank if available and feasible, <br />Purchasinq credits from an approved ln-Lieu Fee proqram if available and feasible. <br />and Permittee Responsible Mitioation (PRM). <br />b. ln order of preference. the followino PRM methods are available: (1) Restoration [re- <br />establishment or rehabilitationl. (2) Establishment lcreation]. (3) Preservation of <br />existinq high qualitv habitats. and (4) Enhancement of deqraded wetlands.. <br />6. Replacement Ratios for Wetland lmpacts. Ratios for compensatorv mitiqation shall be as <br />specified in Table KCC 17.07.070.6. The first number specifies the acreage of replacement <br />wetlands. and the second specifies the acreaqe of wetlands altered. Compensatory <br />mitiqation shall restore, rehabilitate, create, or enhance equivalent or qreater wetland <br />functions. The ratios shall apply to mitioation that is in-kind. is on-site. is the same cateqorv. <br />is timed prior to or concurrent with alteration. and has a hiqh probability of success. The <br />Director mav increase these ratios for remedial mitiqation actions resultinq from unauthorized <br />wetland alterations. dependinq on the nature and extent of the alteration.
