StateofWashingtonDepartmentofEcologyPage15of22AgreementNo:SWMCLCP-2123-KiCoSW-00045ProjectTitle:KiCoSW-00045LitterandIllegalDumpCleanupandPreventionProjectRecipientName:KITTITASCOUNTYSOLIDWASTE•Forprojectswithanyfederalinvolvement,complywiththeNationalHistoricPreservationActof1966(Section106).b)IfrequiredbytheECOLOGYProgram,submitanInadvertentDiscoveryPlan(IDP)toECOLOGYpriortoimplementinganyprojectthatinvolvesfieldactivities.ECOLOGYwillprovidetheIDPform.RECIPIENTshall:•KeeptheIDPattheprojectsite.•MaketheIDPreadilyavailabletoanyoneworkingattheprojectsite.•DiscusstheIDPwithstaff,volunteers,andcontractorsworkingattheprojectsite.•ImplementtheIDPwhenCulturalResourcesorhumanremainsarefoundattheprojectsite.c)IfanyCulturalResourcesarefoundwhileconductingworkunderthisAgreement,followtheprotocoloutlinedintheprojectIDP.•ImmediatelystopworkandnotifytheECOLOGYProgram,whowillnotifytheDepartmentofArchaeologyandHistoricPreservationat(360)586-3065,anyaffectedTribe,andthelocalgovernment.d)IfanyhumanremainsarefoundwhileconductingworkunderthisAgreement,followtheprotocoloutlinedintheprojectIDP.•ImmediatelystopworkandnotifythelocalLawEnforcementAgencyorMedicalExaminer/Coroner'sOffice,theDepartmentofArchaeologyandHistoricPreservationat(360)790-1633,andthentheECOLOGYProgram.e)ComplywithRCW27.53,RCW27.44,andRCW68.50.645,andallotherapplicablelocal,state,andfederallawsprotectingCulturalResourcesandhumanremains.5.ASSIGNMENTNorightorclaimoftheRECIPIENTarisingunderthisAgreementshallbetransferredorassignedbytheRECIPIENT.6.COMMUNICATIONRECIPIENTshallmakeeveryefforttomaintaineffectivecommunicationswiththeRECIPIENT'sdesignees,ECOLOGY,allaffectedlocal,state,orfederaljurisdictions,andanyinterestedindividualsorgroups.7.COMPENSATIONa)AnyworkperformedpriortoeffectivedateofthisAgreementwillbeatthesoleexpenseandriskoftheRECIPIENT.ECOLOGYmustsigntheAgreementbeforeanypaymentrequestscanbesubmitted.b)PaymentswillbemadeonareimbursablebasisforapprovedandcompletedworkasspecifiedinthisAgreement.c)RECIPIENTisresponsibletodetermineifcostsareeligible.AnyquestionsregardingeligibilityshouldbeclarifiedwithECOLOGYpriortoincurringcosts.CoststhatareconditionallyeligiblerequireapprovalbyECOLOGYpriortoexpenditure.d)RECIPIENTshallnotinvoicemorethanoncepermonthunlessagreedonbyECOLOGY.e)ECOLOGYwillnotprocesspaymentrequestswithouttheproperreimbursementforms,ProgressReportandsupportingdocumentation.ECOLOGYwillprovideinstructionsforsubmittingpaymentrequests.f)ECOLOGYwillpaytheRECIPIENTthirty(30)daysafterreceiptofaproperlycompletedrequestforpayment.g)RECIPIENTwillreceivepaymentthroughWashingtonState'sOfficeofFinancialManagement'sStatewidePayeeDesk.ToreceivepaymentyoumustregisterasastatewidevendorbysubmittingastatewidevendorregistrationformandanIRSW-9formatwebsite,https://ofm.wa.gov/it-systems/statewide-vendorpayee-services.Ifyouhavequestionsaboutthevendorregistrationprocess,youcancontactStatewidePayeeHelpDeskat(360)407-8180oremailPayeeRegistration@ofm.wa.gov.h)ECOLOGYmay,atitssolediscretion,withholdpaymentsclaimedbytheRECIPIENTiftheRECIPIENTfailstosatisfactorilycomplywithanytermorconditionofthisAgreement.i)MonieswithheldbyECOLOGYmaybepaidtotheRECIPIENTwhentheworkdescribedherein,oraportionthereof,hasbeencompletedif,atECOLOGY'ssolediscretion,suchpaymentisreasonableandapprovedaccordingtothisAgreement,asappropriate,oruponcompletionofanauditasspecifiedherein.TemplateVersion12/10/2020
