4.2 Timing of Construction and Completion. Except as provided in a Site <br />Development Plan approved pursuant to Section 5.1 below or Applicable Law. there is no <br />requirement that Trendwest initiate or complete development of Mountain Star within any <br />particular period of time, and the County shall not impose such a requirement on any Subsequent <br />Action. Subject to the foregoing. the Parties agree that Trendwest shall be able to develop <br />MountainStar in accordance with Trendwest's own time schedule in light of market conditions. <br />and that Trendwest shall detennine the order in which Phases ofMountainStar shall be <br />developed. <br />Section 5. COOPERATION-IMPLEMENTATION <br />5.1 General Site Plan and Site Development Plan Process. <br />(a) Purpose. The planning and approval process for the development of <br />MountainStar is intended to proceed from the general to the specific, generally in the following <br />sequence: (i) MountainStar Resort Conceptual Master Plan; (ii) General Site Plan: (iii) Site <br />Development Plan(s): and (iv) platting (if required). The MountainS tar Resort Conceptual <br />Master Plan. as approved and conditioned through the MPR Project Development Penn it and <br />MountainStar MPR Conditions. together with the Development Ab,rreement. are intended to <br />provide the generaL conceptual development plan tor MountainStar. It is anticipated that field <br />conditions. market factors, environmental constraints and opportunities, design considerations <br />and other similar factors will cause the MountainStar Resort Conceptual Master Plan and <br />Development Agreement to change and be refined from time to time.
