CHMELIK SITKIN & DAVIS i., December 15,2020 - the Board of Commissioners remanded the proposed Development Agreement back to ERLC ordering ERLC to engage in discussions with the District to determine appropriate mitigation measures to include in the Development Agreement. December 28,2020 - ERLC's legal counsel sends a letter to the District demanding a written response to outline mitigation for the Project, as well as an explanation for mitigation on other developments within the District, though such a requirement was not included in the Board of Commissioner's directive on December i5,2020.5 January 2A21- the District retains legal counselto assist in engaging in discussions with ERLC as ordered by the Board of Commissioners. January 27,2021- the District's legal counsel sends an introduction letter to ERLC's legal counsel, Dean \Mlliams, and requests additional time (until March) to provide a response to the December 28, 2020, ERLC letter.6 March 12,2021- the District's legal counsel provides a letter including proposed mitigation conditions to ERLC.7 March 19,202'l - ERLC's legal counsel responds to the District's March 12th letter.s Again, ERLC demanded that the District provide additional information which was not required by Ordinance No, 2018-0006 or the directive of the Board of Commissioner on December 15,2020. ln this letter, ERLC made a counteroffer to the mitigation conditions identified by the District in its March 12rh letter and requested that the District consider this letter at its upcoming April Commission meeting. No representative from ERLC appeared at the District's April Commission meeting. April 13, 2021- the District's attorney responds to ERLC's March 19th letter.e ln this letter, the District addressed issues and questions raised by ERLC in its March 19th letter and again indicated the mitigation conditions that the District would accept from ERLC. |v|,ay 24,2021 - ERLC responds to the District's April 13th letter.l0 ERLC indicated that it will seek a hearing before the Board of Commissioners based on its assertion that the District is unwilling to engage in discussions and negotiate mitigation conditions.
