DepartmentofJusticeOfficeofJusticeProgramsAWARDCONTINUATIONOfficeofJuvenileJusticeandSHEETPAGE8OF9DelinquencyPreventionCooperativeAgreementPROJECTNUMBER2015-MC-FX-KO39AWARDDATE09/21/2015SPECIALCONDITIONS28.TheOfficeofJuvenileJusticeandDelinquencyPreventionhaselectedtoenterintoaCooperativeAgreementratherthanagrantwiththerecipient.ThisdecisionreflectsthemutualinterestoftherecipientandOJJDPintheoperationoftheprojectaswellastheanticipatedlevelofFederalinvolvementinthisproject.OJJDP'sparticipatoryroleintheprojectisasfollows:a.Reviewandapprovemajorworkplans,includingchangestosuchplans,andkeydecisionspertainingtoprojectoperations.b.Reviewandapprovemajorprojectgenerateddocumentsandmaterialsusedintheprovisionofprojectservices.Provideguidanceinsignificantprojectplanningmeetings,andparticipateinprojectsponsoredtrainingeventsorconferences.29.TherecipientagreestofonvardreportsofICACTaskForceProgramMonthlyPerformanceMeasurestotheOJJDP-designatedsite.30.TherecipientagreestocomplywiththeOJJDPapprovedICACTaskForceOperationalandInvestigativeStandards31.TherecipientacknowledgesthattheOfficeofJusticePrograms(OJP)reservesaroyalty-free,non-exclusive,andirrevocablelicensetoreproduce,publish,orotherwiseuse,andauthorizeotherstouse(inwholeorinpart,includinginconnectionwithderivativeworks),forFederalpurposes:(1)anyworksubjecttocopyrightdevelopedunderanawardorsubaward;and(2)anyrightsofcopyrighttowhicharecipientorsubrecipientpurchasesownershipwithFederalsupport.TherecipientacknowledgesthatOJPbastherightto(1)obtain,reproduce,publish,orotherwiseusethedatafirstproducedunderanawardorsubaward;and(2)authorizeotherstoreceive,reproduce,publish,orotherwiseusesuchdataforFederalpurposes."Data"includesdataasdefinedinFederalAcquisitionRegulation(FAR)provision52.227-14(RightsinData-General).Itistheresponsibilityoftherecipient(andofeachsubrecipient,ifapplicable)toensurethatthisconditionisincludedinanysubawardunderthisaward.Therecipienthastheresponsibilitytoobtainfromsubrecipients,contractors,andsubcontractors(ifany)allrightsanddatanecessarytofulfilltherecipient'sobligationstotheGovernmentunderthisaward.Ifaproposedsubrecipient,contractor,orsubcontractorrefusestoaccepttermsaffordingtheGovernmentsuchrights,therecipientshallpromptlybringsuchrefusaltotheattentionoftheOJPprogrammanagerfortheawardandnotproceedwiththeagreementinquestionwithoutfurtherauthorizationfromtheOJPprogramoffice.32.ICACAnnualReportsTherecipientagreestosubmitannualreportstoOJPthatsetforththefollowing:(A)ThenumberoflawenforcementagenciesparticipatinginInternetcrimesagainstchildrenprogramstandardsestablishedbythetaskforce.(B)Staffinglevelsofthetaskforce,includingthenumberofinvestigators,prosecutors,educationspecialists,andforensicspecialistsdedicatedtoinvestigatingandprosecutingInternetcrimesagainstchildren.33.TherecipientagreestosubmitquarterlyreportstoOJPthatsetforththefollowing:Prosecutionperformancemeasuresoftheleadtaskforceagencyandanyaffiliatesreceiving$20,000ormoreinsubrecipientfundingperprojectperiodyear,including-1)thenumberofprosecutionsforIntemetcrimesagainstchildren;2)whethertheprosecutionresultedinaconvictionforsuchcrime;and3)thesentenceandthestatutorymaximumforsuchcrimeunderStatelaw.OJPFORM4000/2(REV.4-88)
