Cook <br />RECOMMENDATION: <br />Direct staff pursue securing a permanent, non-exclusive properly conditioned easement <br />from Department of Natural Resources (DNR) supporting the Dickey Creek Bridge <br />replacement project. <br />BRIEFING SUMMARY: <br />• The Dickey Creek Bridge replacement project requires the establishment of a new <br />road alignment. <br />• Public Works proposes "swapping" our existing right of way for new right of way <br />obtained from DNR. <br />• DNR apparently does not "swap" right of way with local agencies. <br />• The standard DNR lease does not contemplate typical road maintenance issues <br />associated with County Road maintenance activities. <br />• County Surveyor Turnbull has "marked up" the standard DNR lease for DNR <br />consideration. <br />• DNR staff has cautioned Public Works the Attorney General (AG) review of our <br />requested changes will likely take several months to review. <br />• It is likely that PW will now require Western Federal Lands to push the project <br />back one full year. <br />BACKGROUND: <br />PW is fully funded to replace the Dickey Creek Bridge (Tearaway Road) and realign <br />road approaches using a Federal Highway Administration grant. PW proposes <br />exchanging like for like as it relates to existing and future road right of way. DNR does <br />not exchange right of way with local governments. The standard DNR is not acceptable <br />to PW. PW is providing suggested revisions to the DNR standard lease that will require <br />AG review. That review is anticipated to take several months.
