SPECIAL TERMS AND GONDITIONS <br />INTERAGENCY GRANT AGREEMENT <br />FEDERAL FIJNDS <br />Program lncome shall be used to conlinue the sam€ activities to benelit low- and moderate-income <br />persons or, with COMMERCE approval, for other activities to benefit low- and moderate-income <br />psrsons- lnterest earned in excess of $100 on CDBG funds received to reimburse incuned costs must <br />be remltted to COMMERCE for return to the U.S. Treasury. <br />14. PROHIBITION O.N CEBTAIN FUNDS TRANSFERS <br />The Grantee that directly or indirectly receives CDBG-CV funds may not sell, lrade, or olhemise <br />transfer all or any such potion of such funds lo another such entity in exchange for any other funds, <br />credits or non-Federal consideration, but must use such funds for activltles ellgible under title I of the <br />HCD Act or permiited by waiver and alternative requirements that apply 1o the use of CDBG-CV funds, <br />16. SUBCONTRACTOR DATA COLLEGTION <br />Grantee will submit reports, in a form and format to be provided by Commerce and at intervals as <br />agreed by the parties, regarding work under this Grant performed by subcontractors and the portion of <br />funds expended for work perbrmed by subcontractors, including but not necessarily limited to minority. <br />owned, woman-owned, and veteran-owned business subconlractors. 'Subcontractors" shall mean <br />subcontractors of any lier, <br />16. SUF_CONTRAGTS, FOR ENGTNEERING S,EBVICES <br />Engineering firms musl certifo that they are authorized to do business in the state of Washington and <br />are ln full compliance wlth the requirements of the Board of Professional Registration. The Grantee <br />shall require that engineering services providers be covered by errors and omissions insurance. The <br />engineering firm shall maintain minimum limits of no less than $1,000,000 per occurrence to cover all <br />activilies by the engineering llrm and licensed staff employed or under contract to the engineering firm, <br />The state of Washington, its agents, officers, and employees need nol be named as additional insureds <br />under this policy. <br />17. ORDEROF PREGEDENCE <br />ln lhe evenl of an inconsistency in lhis Grant, the inconsislency shall be resolved by giving <br />precedence in the following order: <br />. Appllcable federal and state of Washington stalutes and regulationso Special Terms and Conditions. General Terms and Conditionsi Attachment A - Scope of Work and Budget. Attachment B - Letter to lncur Cost, if applicable.
