�Gyc�n¢3...'N>ryf�OCG <br />3Hr,Z2'TZTAtB COUNTY <br />DEPARTMENT OF PUBLIC WORKS <br />PUBLIC HEARING <br />DIRECTOR'S REPORT <br />PROPOSED VACATION OF PLATTED RIGHT OF WAY WITHIN TIMBER <br />VALLEY DIVISION 1 PLAT <br />An application for a road vacation of platted right of way within Timber Valley Division 1 was received <br />by Public Works on February 16, 2021 (EXHIBIT 1). The applicant (Josh Benson) is requesting partial <br />vacation of platted right of way as follows: Cie Elum Road, Little Creek Road and Timber Road <br />(EXHIBIT 2). The rights of way are located in portions of the SW Y2 of Section 26, Township 20 North, <br />Range 14 East, WM Kittitas County, WA. <br />Kittitas County Code 12.22.040 requires a Director's Report for all vacation requests. <br />The adjoining property of the proposed vacation falls to a single ownership, the details of which are as <br />follows: <br />Parcel ID: 471334 <br />Map No.: 20-14-26053-0084 <br />Owner Name: BENSON, JOSHUA E, HULL, LACEY M <br />Requirements of RCW 36.87.040 Director/Engineers Report: <br />1. Whether County road right of way should be vacated or abandoned. <br />2. Whether road is in use or has been in use. <br />3. The condition of the road. <br />4. Whether it will be advisable to preserve it for the county road system in the future. <br />5. Whether the public will benefit by the vacation. <br />6. A determination by appraisal of the fair market value of the area sought to be vacated <br />7. Whether the proposed area to be vacated contains utilities. <br />8. All other matters which will be of interest to the board including an itemized list of costs and <br />expenses incurred in the examination, report, appraisal and all proceedings pertaining to <br />such petition to vacate and abandon. <br />Required Report Elements Pursuant to KCC 12.22.040 (Mirror RCW 36.87.040): <br />1. Timber Valley Division 1 plat was recorded in April 1973 (EXHIBIT 3). The various rights of <br />way depicted on the face of the plat were no constructed in their entirety following final plat. <br />The portions of the various plat roadways being requested for vacation have not been <br />constructed since 1973. The rights of way are dedicated to the County for public use <br />although the internal road network is private. <br />2.
