17 8.02.155 Critical areas. <br />"Critical areas" includes the following areas and ecosystems: (a) Wetlands; (b) areas with a critical <br />recharging effect on aquifers used for potable water; (c) fish and wildlife habitat conservation areas; <br />(d) frequently flooded areas; and (e) geologically hazardous areas. "Fish and wildlife habitat <br />conservation areas" do not include such artificial features or constructs as irrigation delivery systems, <br />irrigation infrastructure, irrigation canals, or drainage ditches that lie within the boundaries of and <br />are maintained by a port district or an irrigation district or company. Natural watercourses such as <br />streams and rivers that carry irrigation water are not considered to be an artificial feature. (Ord. <br />2016-006,2016) <br />178.02.160 Critical aquifer recharge area (CARA) <br />"Critical aquifer recharge area (CARA)" means an area designated by WAC 365-190-100 that is <br />determined to have a critical recharging effect on aquifers (i.e., maintain the quality and quantity of <br />water) used for potable water as defined by WAC 365-190-030(3). (Ord. 2016-006,2016) <br />17 8.02.165 Critical facility. <br />"Critical facility" means a facility for which even a slight chance of flooding, inundation, or impact <br />from a hazard event might be too great. Criticalfacilities include, but are not limited to, schools, <br />nursing homes, hospitals, police, fire and emergency response installations, and installations that <br />produce, use, or store hazardous materials or hazardous waste. (Ord. 2016-006,2016) <br />17 8.02.1 67 Cultura I resources. <br />"Cultural resources" means archaeological and historic sites and artifacts, as well as those traditional <br />food, medicine, fibers, and objects that sustain the religious, ceremonial, and social activities of <br />affected Native American tribes. (Ord. 2019-003, 2019) <br />178.02.170 Dam. <br />"Dam" means a barrier or controlling and appurtenant works across a stream or river that does or <br />can confine, impound or regulate flow or raise water levels for purposes such as flood or irrigation <br />water storage, erosion control, power generation, or collection of sediment or debris. (Ord. 2016-006, <br />2016) <br />17 8.O2.17 5 Deg radatio n. <br />"Degradation" as it pertains to riverine morphology means the lowering of a streambed due to such <br />factors as increased scouring. (Ord. 201 6-006, 2016) <br />1 78.02.1 80 Development. <br />"Development" means a use consisting of the construction or exterior alteration of structures, <br />dredging, drilling, dumping, filling; removal of any sand, gravel or minerals; bulkheading; driving of <br />pilings; placing of obstructions; interior building improvements that do not change the use or <br />occupancy; or any project of a permanent or temporary nature that interferes with the normal public <br />use of the surface of the waters overlying lands subject to the Shoreline Management Act at any <br />stage state of water level.
