" :.ro.S'"il#"ru,ffii11:s <br />BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTTON No. 2or -a)_lQ I <br />VACATING PORTIONS OF'NELSON CREEK ROAD, TIMBER VALLEY ROAD AND <br />LITTLE CREEK ROAD WITHIN THE PLAT OF TIMBER VALLEY DIVISION 1 <br />WHEREAS: Washington State contemplates the need for County's to vacate roads and rights <br />of way at Revised Code of Washington (RCW) Chapter 36.87; and <br />WHEREAS: Kittitas County Code (KCC) mirrors the requirements for road and right of way <br />vacation at KCC 12.22.040, and <br />WHEREAS: The Department of Public Works received a request to vacate portions of rights of <br />way located within Division 1 of Timber Valley Q.{elson Creek Road, Timber <br />Valley Road and Little Creek Road) on February 16,2021; and <br />WHEREAS: Public Works has completed the required vacation report (RCW 36.87.040) at <br />KCC 12.22.040, and <br />WHEREAS: The Kittitas County Board of County Commissioners did hold the required public <br />hearing considering the right of way vacation request on April 20,2021. <br />NOW' THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the <br />best interest of the public, does hereby authorize the partial vacation of rights of way located in <br />Division 1 of Timber Valley (attached) and directs the County Engineer to update (as pertinent) <br />the County Road Log and other documents associated with the right of way vacation. <br />DATED this 20th day of April202I, at Ellensburg, Washington. <br />BOARD OF COLINTY COMMISSIONERS <br />KITTITAS CO GTON <br />Brett Chairman <br />,E/Cter|of the Board- Julie Kjorsvik <br />!
