The DHS Awara Lefter is <br />incorporated in this Agreement as Aftachment C. <br />The_ Subrecipient acknowledges that since this Agreement involves federal award funding, the period ofperformance may begin prior to the availability of appiopriated federal funds. The Subrecipient igrees inat it wiltnol hold the Department, the state of Washington, or the United States liable for any Oamiges, claim forreimbursement, or any typ-e of payment whatsoever for services performed under tnls Rgree-ment prior todistribution of appropriated federal funds, or if federal funds are not appropriated or in a particirlar amount. <br />Attachrnent A <br />SPECIAL TERMS AND CONDITIONS <br />ARTICLE I. ' <br />STATEAND FEDERAL REQUIREMENTS FOR DHSIFEMA PREPAREDNESS GMNTS: <br />The following requirements apply to all DHS/FEMA Preparedness Grants administered by the Department. <br />1. SUBAWARDS & CONTRACTS BY SUBRECIPIENTSa. lf the Subrecipient also becomes a pass-through entity by making a subaward to a non-federal <br />entity as its subrecipient, the Subrecipient must make a cas+by-caie determination whether each <br />agreement it makes for the disbursement of 2OHSGP funds received under this Agreement casts <br />the par$ receiving the funds in the role of a subrecipient or contractor in accordance with 2 CFR <br />200,330. <br />i.
